“Americans Are Paying Knox $10,000 A Gig To Trash Italian Cops - Smart Move Liberating Her”

1. Americans Knox Has Hoaxed

So the news is out to considerable disgust that Knox is being paid up to $10,000 a gig plus costs to lie about her case.

Now she is going global on Netflix’s tail and seeks to hoax bleeding-heart Irish via another Kabuki-style paid interview. Knox has lied to and defrauded these groups so far.

That adds up to thirteen, a lot of people Knox has directly hoaxed, to say nothing of her book and of the millions Netflix has hoaxed. Plus the presumed Irish lovefest this weekend.

2. The Misleading Marketing Pitch

Here is the pitch for Knox on the All American Speakers site.

Amanda Knox was tried and convicted for the murder of British student Meredith Kercher, who died from knife wounds in the apartment she shared with Knox in 2007. Knox and her then-boyfriend, Raffaele Sollecito, were both found guilty of killing Kercher, receiving 26- and 25-year prison sentences, respectively. In October 2011, Knox and Sollecito were acquitted and set free. In March 2013, Knox was ordered to stand trial again for Kercher’s murder; Italy’s final court of appeal, the Court of Cassation, overturned both Knox’s and Sollecito’s acquittals. Knox and Sollecito were again found guilty of murder in February 2014, with Sollecito receiving a 25-year prison sentence and Knox receiving a 28.5-year sentence. The Supreme Court of Italy overturned her and Sollecito’s convictions in 2015.

3. How That Pitch Misleads

The marketing of Knox as cash-cow is replete with wrong implications, to get the paying customers quickly on the hook before it occurs to check with Italy. Here are several:

1. “There were several trials and Italy just kept trying”

Untrue. In fact (1) there was ONE very definitive trial, in 2009; (2) Knox and Sollecito appealed in 2011 on very narrow grounds and were wrongly set free as appeals were not done; that court was provably bent and the result was annulled by the Supreme Court’s First Chambers (the “murder court”); (3) the First Chambers (not the prosecutors) ordered a repeat of the first appeal in 2013-14 and the 2009 guilty verdict was confirmed; (4) in Knox’s and Sollecito’s final appeal a provably bent Fifth Chambers (which normally never handles murders) declared them not guilty but involved anyway in the mother of all weird rulings. Had that appeal correctly gone back to First Chambers, they would still be locked up.

2. “All four years Knox was in prison were unjustified”

Untrue. In the first year she repeatedly failed to convince courts including even the Supreme Court, in the face of ever-mounting evidence, that she should make bail or house arrest or be released entirely. The other three years were fully justified because with no provocation she accused an innocent man of murder and never ever retracted her claim.  Endemically Knox tries to make out her “interrogation” was forced and therefore it was all the cops’ fault not hers.  But see here. There was actually no interrogation as such at all, she was not forced to confess, the malicious accusation of murder against an innocent man was spontaneous, and she sustained it for several weeks.

3. “Knox was exonerated proving lower courts wrong”

Untrue. Knox was not exonerated. And the provable bending of three courts is ignored. The mafia role in sliming Italian justice and liberating the pair is swept under the rug. Almost every Italian has long known what was going on but to talk about it or write about it is not something they like to do. The existence of the mafias does not make them proud and to talk of them is not always safe. We first wrote extensively here and most recently again extensively here about why and how the manipulations occurred.

4. “Knox is a model for all prisoners wrongly held”

Untrue. They can learn nothing from this. Maybe 200,000 are wrongly held in the US; are any seeing a way out via Knox? There is no mention of the role of the brutal PR campaign which few could afford. Omitted is how damaging and dishonest it was and still is, how destructive to so many additional victims of Knox, and how focused on making a buck. Knox is not the only speaker being paid to lie to crowds; others are as well. Numerous books and articles are involved and media and consultant fees. This is a cash industry now, not a charity, with Knox as hallowed cash-cow.

4. Where This Hoaxfest Goes Next

More and more is out in the open. There are attempts to change the subject when curiosity about these subjects is on the rise - but notice how there is no direct pushback and there are no legal threats. Those who have foolishly acted as witting or unwitting mafia tools want zero attention to their roles here.

Don Corleone surely smiles broadly in his grave. Never has Italian justice been trashed around the world on a scale anything like this. Very nice if groups who have rented Knox and become aware they were hoaxed choose to demand their $10,000 back right now. That’d end the blood-money flow at one stroke.

Knox & Sollecito: How From Their Very First Questionings The Cracks & Fissures Start To Appear #2

1. The Much Mischaracterized Interview Context

You’ve read the PR-driven meme that Perugia investigators zoomed in way too quickly on Amanda Knox?

And also on Raffaele Sollecito? No, probably not Raffaele. He is a really big nuisance in proving any malicious targeting. Hard to manufacture a reason to zoom in on an Italian male with a rich and connected father and mafia ties.

Say that investigators were doing little else but ferociously framing Amanda Knox, as John Douglas, Steve Moore and Michael Heavey have claimed again and again (and even so advised the Department of State).

Well-trained American investigators will say they are lucky to average upward of a dozen sessions a week with people of possible involvement. If Douglas, Moore and Heavey have it right, what is your best guess here? Five? Seven? Maximum ten?

Okay. Take a look. Amazing, right? And there were many more still in progress. Interviewing went on for weeks. They are all loaded on the Case Wiki. Never recorded, as the PR lie has it? No, literally everything was captured.

Unfair zooming-in? These depositions prove quite the opposite. Right through to the fourth and ultimate session on 5 November, the investigators were mainly in the mode of spreading the net wider and wider. Seeking still others maybe involved.

2. Analysis Of Knox’s First Statement Continues

Remember this is still the same day Meredith’s body was discovered. We are still on the 2 November deposition which sets narrow limits on what Knox could credibly claim later. (Path dependency, for scientists.)

Maybe Douglas, Heavey and Moore would have missed them?! But I’ll point out more Knox claims that for competent law enforcement would be big red flags. Points that dont match up with Knox down the road, and points that don’t match up with Sollecito.

This morning, around 10-11am, I returned to my house alone to have a shower and change my clothes, and in this circumstance I noticed that the entrance door of the apartment was wide open whereas the doors to the rooms inside the house were all closed, at least the ones to Filomena’s and Meredith’s rooms, although I didn’t check if they were locked, whereas the one to Laura’s room was ajar and my door was open as usual.

Why would she say the door of the apartment was wide open?  Remember, we only have Knox’ word for this.  We know it needed a key to lock it.  In Honor Bound, Raff says this applied both coming in and going out.  Imagine for a minute the real reason for returning was to continue tidying up.  The aim had been to finally leave the cottage with the door left flapping open (as though by an unknown intruder).  If it had been locked, then the conclusion would be it must be Knox, as she and Meredith were the only house mates around that weekend.  So, of course, she has to claim it was open.  Distancing herself.

She says she “˜didn’t check if they were locked’ (Filomena’s and Meredith’s rooms).  But why would they be locked.  This indicates an awareness that Meredith’s room was locked.  To explain why she didn’t spot it then, we have the made-up-on-the-spot event, which turns out to be a non-event.  Rather like Gubbio.  They were going to “˜go to Gubbio’, but then they didn’t go.

We see from Knox’ statement, she wants to tell the story as though she really was innocent.  She has to imagine and play role what an innocent person would do.  The door was hanging open.  She was only there because she wanted to shower and change to go to Gubbio   Ah, but what about Meredith’s locked door?  Didn’t try it to see if it was locked.  Which of course it was.  Perhaps Knox has psychic powers to foresee that it might be found to be locked in the future.  Pre-empting and forestalling the tricky question of Meredith’s closed door.

These things seemed really strange to me because, like I already said, it is customary for all of us to always close the entrance door with a key since that is the only possible way to close it. So I started to call [the names of] the girls aloud, but without getting an answer. At that moment I thought that maybe one of the girls had gone out to throw the trash into the bins, or to go to see our neighbors, the boys, who occupy the apartment below ours and with whom we hang out.

Knox claimed she didn’t know Laura and Filomena were away for the weekend until Filomena told her on the phone after she rang her at midday on 2 Nov 2007, a couple of hours later.  But seriously, if there are three possible housemates around, wouldn’t one just call, “˜Hello!  Anybody home?’ 

Truth is, Knox doesn’t want to say she knew Meredith was the only one around, as the next question would be, “˜So what happened when you called Meredith’s name and knocked on her door, and tried the handle’.

Meredith home alone, would be a real reason to panic.  The realisation “˜Meredith might be hurt inside’ mustn’t come ““ for script purposes ““ until after Knox has - in her story - had a shower, changed and gone back to Raff to tell him of her strange experience.  She has to account for going back to his abode and ringing Filomena from there.  Rather than ring him from the cottage, she has to walk there and then walk back with him.  After a leisurely breakfast, of course.

Still imagining herself in the role of innocent, she has to dream up why, if she thought all housemates were around they didn’t seem to be after all, so here comes the precluding: “˜I thought that maybe one of the girls had gone out to throw the trash into the bins, or to go to see our neighbors’.

I remember having closed the front door of the apartment, but I didn’t lock it with the keys, and I went to the bathroom located near to my room, the one that only me and Meredith usually use, to have a shower, when I noticed drops of blood on the floor and a bigger blood stain on the bath math and other blood stains on the sink as if someone had smeared it with a bloody hand. This thing seemed a bit strange to me because we girls are all fairly clean and tidy, and we clean the bathroom [immediately] after we have used it. At first I thought that the blood on the sink could be mine because I did some ear piercings about a week ago, so I immediately checked in the mirror and touched my ear. Then I touched the blood on the sink but seeing that it was not removed immediately, that is, it was not recent, I thought it could be some girl’s menstrual blood and because it disgusted me, I did not attempt to clean it.

Reason for not raising the alarm or becoming concerned?  I thought it could be some girl’s menstrual blood and because it disgusted me, I did not attempt to clean it.

Again, a clever lie (or so she thought) whilst expressing her disgust at Meredith’s life blood, it would “˜explain’ why she thought nothing was amiss, just a bit strange (she reasons).  As Meredith was the only other person who used that bathroom, we note the careful avoidance of using her name and the use of “˜some girl’ instead.  Remember, at this stage, she is not to know anything has become of Meredith.  Could be anybody’s blood, is the message, with an innocuous cause (albeit “˜disgusting’.)

No mention of padding back to her room on the “˜disgusting’ bathmat to fetch a towel after the shower, which seems to be a story that evolved later, when her lawyers told her of the five isolated luminol prints in the hallway identified as “˜compatible’ with hers and Raff’s.

Immediately after this I went to the other bathroom, where I usually dry my hair, and after having dried it, I noticed that there were feces in the toilet, that is, someone had used it to relieve themselves, but they had not flushed afterwards. This thing also seemed strange to me for the reasons that I have already stated, and so I avoided flushing it myself.

Again we have the liar’s ready explanation as to why the toilet was left in a disgusting state, even though at this stage, she wasn’t spooked enough to think there was anything to be concerned about.  No, the real reason it was “˜strange’, was that according to Knox, nobody who visited the cottage would ever have not flushed the loo.  So that explains why it dawned on her when they realised there had been a burglary that this faece must be the burglar’s.  She ”˜avoided flushing it’ herself, she explains to police, because she had some kind of uncanny intuition it didn’t belong to anybody in the house, nor their friends.

As for Knox shock at the poop, Sophie Purton testified to the court:

One thing in particular that I remember very well regards Amanda’s habits in the bathroom. Meredith said that Amanda often did not flush the toilet. [This] annoyed her and she wanted to do something about it but did not know what to do without creating problems, not wanting to create embarrassing situations.

Same complaint by those in prison with Knox. She does on:

Later I took the mop, which was located inside a closet, and I left my house to go to my boyfriend’s house to clean his room [kitchen] because we had soiled it the previous night. I remember that when I left, around 11.30 am, but I’m not sure about the precise time as I didn’t look very carefully at the clock, I closed the door of the apartment with a turn of the key.

In Knox’ court testimony and police interviews, her favourite refrains are “˜I wouldn’t know what time it was, as I don’t look at the clock’.  One wonders how appropriate this type of sarcasm is in front of murder detectives and a panel of judges.  As Francesco put the time of the pipes leaking at before 8:42 and Knox put it back considerably later, changing it from 9:30, to 10:00 and then to 11:00 pm, we see her dilemma.  She has to say she only took the mop to Raff’s that morning or she’s admitting she returned to the cottage on the night of the murder.

After arriving at the house of my boyfriend, who lives alone in an apartment near my house and to be more precise in Corso Garibaldi number 110, we stayed there for about an hour, for the time it took to clean the kitchen and have some breakfast, after which we returned to my house together. I want to point out that I immediately told my boyfriend about the strange things that I had detected in my house, and he urged me to call one of the girls.

Immediately? That came and went. Here it’s all action, systems go.  The ditzy Knox needed caring Raff to get her to start worrying.  So first two calls to Meredith’s phones.  Then Filomena.  She again has to be told to “˜ring Meredith’, this time by Filomena.  So she dutifully rings Meredith again, this time, just a quick couple of seconds each.  Been there, done that.

And I did indeed first call [emphasis added] Filomena to ask her if she knew anything about the blood I had found in the bathroom, and she replied that she knew nothing about it as she had slept at her boyfriend’s, Marco’s, house the previous night, and the following morning, that is, this morning, she had gone directly to work without going home first. After Filomena, [emphasis added] I phoned Meredith three times and to be more precise, the first time I called her, I called her English cell phone number 00447841131571, which is the first phone number Meredith gave to me, and which I saved first to my phone card; the phone rang several times, and at one point I heard the line disturbances and interruption of rings. So I tried to contact her on the phone with the number 3484673711, and also this time the phone rang but no-one answered. I tried calling her for the third time with the first cell phone number again, but also this time without getting an answer.

I didn’t call Laura because Filomena had told me in the previous phone call that she had gone to Rome, but I don’t remember if Filomena told me when she had left. So I haven’t seen Laura since the afternoon of October 31st this year. At this point, I returned to my house with my boyfriend, worried about Meredith, because she was the only one whose whereabouts I didn’t know of.

As we know, this call was 12:11 yet Knox & Sollecito didn’t actually get to the cottage until circa 12:35, when by coincidence the postale police arrived and Filomena rang Knox again.  This time, she was told of her smashed window.  Knox and Sollecito were so “˜worried about Meredith’ it took over twenty minutes to carry out what should be a five-minute walk. 

Knox doesn’t tell police that the first call she made, after having switched off her phone 20:45 the night before, was at 12:08 to Meredith’s two phones, before she ring Filomena.  So a clear lie, that it wasn’t until Filomena mentioned it that it occurred to her to ring Meredith.  She didn’t realise, either, that police could discover just how long she rang for.  We see it is a nonsense “˜no-one answered’ if they only rang for three seconds or less.  Another sleight of hand, changing the chronology, which takes on a different light when the true time line comes to light.

When I got to my house, around 1 pm, I opened the front door, which I found locked, and entered the apartment. I began to open the doors of the rooms occupied by the other girls. First, I opened Filomena’s bedroom door, that is the first room nearest to the entrance, and together with Raffaele we found that the window, with two shutters, was open and the window glass was broken. I don’t remember if both glasses were broken or only the other one. Broken glass was scattered on the floor, inside the room, near the window. Scared, I thought it could be that a thief had entered the house, and then I quickly glanced around to check that everything was in order, and that nothing had been removed. So I headed to Laura’s room and also there I opened the door and checked that everything was in order. I want to point out that I didn’t go inside the rooms, that I just had a quick look, from the door.

Immediately after that I went into my room, and even there I didn’t notice anything / nothing was different, after which I headed to Meredith’s room, but I couldn’t open the door because it was locked.

Given, having just rang Meredith’s phones three times, and now being told by Filomena that she and Laura were both away for the weekend, you’d think Meredith’s room would be FIRST priority.  Instead, in her account, Knox checks the other two instead, even though Sollecito stated Filomena’s door was wide open when he arrived.  Laura’s door was “˜ajar’ and had a drawer hanging out, and surprise, surprise, Knox’ hunch about Meredith’s door being locked, turns out to be correct, but she only finds out now, some two hours later.

Knox goes to her room, on a dark November day, and doesn’t notice her table lamp is missing (it is on the floor of Meredith’s room) and she would have had to dry herself after the shower (she claims) and change in the dark, as the room had very little natural light.

At that point I looked out from the bathroom terrace, leaning forward to try and see the window of Meredith’s room, but I couldn’t see anything, after which I returned to the door to look through the keyhole and I could only see Meredith’s handbag on the bed. I retraced my steps to take another look at all the rooms without, however, entering any of them and without noticing anything unusual. Immediately after that I entered the first bathroom near the entrance to the apartment where I very quickly looked around without paying close attention to whether the feces were still inside the toilet.

Knox keeps telling the police she didn’t enter any of the rooms, as though she was being carefully to not contaminate any evidence nor disturb the mise en scene the police see set out before them.

At that point while Raffaele remained in the apartment, I went down to the downstairs students’ apartment, and above all to talk with Giacomo hoping he would have news of Meredith’s whereabouts, but no-one answered the door. After I had returned to the apartment, Raffaele decided to call his sister for advice on what to do, and immediately after that call he called, I don’t know if it was the state police (Polizia) or Carabinieri, to come to the house, and in the meantime, I contacted Filomena at her cell phone number 3471073006 to inform her we had found the window panes in her room broken, and that Meredith’s room was locked. She replied that she would join me at once.

So now, the lead up to the discovery of the body is in full swing.  Filomena is on her way, and so are the police.  Once again liar Knox changes the chronology and the correct order of things.  Note how here, Raff calls his sister (a very brief 39 seconds) before Knox claims she contacted Filomena to tell her of the broken window.  Firstly, this would place Raff’s call at 12:35, and we know it was actually 12:47.  Secondly, Knox only called Filomena once, and that was at 12:11. Filomena had to ring Knox ““ for the third time ““ at circa 12:35, when she was informed of the mayhem in her room.  Police later found out the real time of Sollecito’s call.

Raffaele, who was worried about Meredith’s safety, tried to break the door to her room by kicking it without success, and immediately afterwards we saw the plainclothes police arrive. After they showed us their identification cards, they inquired about our particulars and our cell telephone numbers. Then they asked us what had happened. We told them about the window we had found with the shattered glasses, about the blood stains found in the bathroom, and about Meredith’s room that was strangely locked. The policemen asked us questions about the people who occupied the house and about the telephone calls made, and in the meantime a friend of Filomena whom I know as Marco, and two other friends of hers I didn’t know, arrived. At that point Filomena began to talk to the policemen, and while I stood aside in the kitchen, the others together with the policemen headed for Meredith’s room and broke down the door. I can’t specify who really proceeded to break down the door. At that point I heard Filomena screaming and saying “a foot, a foot” while the police officers ordered us all to go outside the apartment.

At that point while Raffaele remained in the apartment, I went down to the downstairs students’ apartment, and above all to talk with Giacomo hoping he would have news of Meredith’s whereabouts, but no-one answered the door. After I had returned to the apartment, Raffaele decided to call his sister for advice on what to do, and immediately after that call he called, I don’t know if it was the state police (Polizia) or Carabinieri, to come to the house, and in the meantime, I contacted Filomena at her cell phone number 3471073006 to inform her we had found the window panes in her room broken, and that Meredith’s room was locked. She replied that she would join me at once.

At that moment I learned from my boyfriend that inside Meredith’s room, in the wardrobe there was a girl’s body covered with a sheet, and the only thing you could see was a foot. None of those present mentioned the name of Meredith, and as I left the house immediately after that without having seen the body, I can’t state whether it’s her.

What’s interesting is what Knox omits.  She fails to mention calling her mother at 3:57 am Seattle Time, soon before Luca kicked open the door at circa 13:05.

These “additionallys” are likely answers to further impressive and unexceptionable questions by the police.

Additionally: There are four Italian students living in the apartment on the lower floor of my house, and we often gather together to play the guitar; together with them we also went out a few times to go for a dinner, and once we went to a disco. Meredith and I went out more times together with all the four boys than the other two (Laura and Filomena). These guys are respectively called Giacomo, Marco, Stefano and the fourth, with whom I personally speak very little, I seem to remember is called Riccardo. I know that one of the four guys, to be precise, Giacomo, is Meredith’s boyfriend. In fact, Meredith sometimes slept at Giacomo’s house and sometimes Giacomo came to our house to sleep with Meredith. I want to point out that the two didn’t very often go out together as Meredith went out with her English friends while Giacomo, from what Meredith told me, preferred to spend more time at home.

Additionally: Regarding the house keys, I can say that they are available to each of us, but I don’t know that other outsiders would be in possession of any copies of them, including Raffaele, my boyfriend. I’m sure Filomena gave no key to Marco, her boyfriend, since every time he arrives at our house he always knocks at the door very loudly. Laura doesn’t have a boyfriend, whereas regarding Meredith, I can say that knowing her I don’t think she had given keys to Giacomo even if I can’t definitely rule it out.

Additionally: Meredith and Giacomo had only been seeing each other for a few weeks, and as for their relationship, Meredith herself told me that it was going well, she never talked about any quarrels with Giacomo, whom I moreover find a very quiet guy. As I’ve already said, she went out very often with her English friends, and they used to attend the disco pub “Merlins”. Once I went there too, and another time we went to another disco pub. Both times there were just us girls.

Additionally: Meredith and I did not celebrate Halloween together, in that I, that evening, was at the “Le Chic” pub, but not for work, but I know she went to “Merlins” with her English friends and without Giacomo, as she told me herself just yesterday. She told me that she had a lot of fun. She did not tell me about any new acquaintances made that evening. From what I know she always went out with the same friends, including me, or with Giacomo and his friends. She usually did not go out alone in the evening.

Additionally: I can describe Meredith as a girl of 21 years or age, of English nationality, about 1.70cm (5’7’‘) tall, thin build, olive complexion, black hair smooth and long, brown eyes. I don’t think she had any particular marks such as tattoos or other marks on her body. The last time I saw her, she was wearing white jeans and a short, light, pale-colored jacket.

Her email to her address book contacts came some 36 hours later, and we can see how she attempts to consolidate what she told the police.  This becomes a script which she commits to memory in strict chronological order as is in the manner of a liar, in order to keep track of their falsehoods.

Knox & Sollecito: How From Their Very First Questionings The Cracks & Fissures Start To Appear

“Now I say… and then you say… and then I say… and then you say”


Reference the caption above: that’s the last time they talked before their first questionings.

Each day the cracks and fissures got worse. Would any cop not get suspicious?! Three days later, Sollecito separates with a bang and proclaims that Knox had made him lie.

That sure went well. Next murder Knox may do alone… A good primer for this post is this guide on how to read lies.

Here’s my take on the Recorded Statement taken from Amanda Knox 2 Nov 2007 in Part 4 of our previous post below.  It is timed at 3:30pm.  Mignini arrived about 3:00.

It could be the Squadra Mobila (the Flying Squad attached to the Carabinieri) took statements at the scene as Knox had to wait at the Questura quite a while before she was spoken to and got home late. 

I have only processed three or four paragraphs so far (so this could turn into a whole series).  What jumps out at me is the following statement:

Around 5 pm I left my house together with Raffaele to go to his house where we stayed the whole evening and the night.

In Sollecito’s own statement of 2 Nov 2007, in Part 5 of the previous post, he states: 

At about 4:00 pm, Meredith left without saying where she was going, while we stayed at home until about 17.30. After that hour, Amanda and I took a little trip to the center to go to my house where we stayed until this morning.

So, from having been at Via della Pergola for lunch, during which time, Sollecito joined her and Meredith had got out of bed after arriving home in the early hours, and according to Knox and Sollecito, still had the remains of vampire makeup on her chin, was wearing her ex-boyfriend’s jeans, and had gone out at four, “˜without saying where she was going’, the pair claim to have gone straight to Raff’s apartment in Via Garibaldi, “˜at about five’.  In Sollecito’s earliest account, it was to go to his house via the centre.

The next written record we have comes from Knox email home to 25 people in her address book on Sunday 4 Nov 2007, in the early hours circa 36 hours or so after Meredith’s body was found.

meredith came out of the shower and grabbed some laundry or put some laundry in, one or the other and returned into her room after saying hi to raffael. after lunch i began to play guitar with raffael and meredith came out of her room and went to the door. she said bye and left for the day. it was the last time i saw her alive. after a little while of playing guitar me and raffael went to his house to watch movies and after to eat dinner and generally spend the evening and night indoors. [sic]

Many believe this was Amanda writing out a “˜script’ to “˜get her story straight’.  One thing about liars, is that they stick rigidly to a set chronology to make it easier to remember their lies.

The next written record is Sollecito’s first written statement to the police:

Raffale Sollecito: November 5th 2007 at 22:40 in the offices of the Flying Squad of the Perugia Police Headquarters

QA Around 16:00 Meredith left in a hurry without saying where she was going. Amanda and I stayed home until about 17:30-18:00.
QA We left the house, we went into town, but I don’t remember what we did.
QA We stayed there from 18:00 until 20:30/21:00. At 21:00 I went home alone because Amanda told me that she was going to go to the pub Le Chic because she wanted to meet some friends.

For the first time we are made aware that the pair went somewhere after leaving Via della Pergola at between “˜5:30 and 6:00’ according to Raffaele’s statement, this glides neatly into Popovic’s visit at 6:00pm at Raff’s abode.  No visible gaps in the timeline here.

Next comes Knox’ handwritten statement to the police:

“˜Thursday, November 1st I saw Meredith the last time at my house when she left around 3 or 4 in the afternoon. Raffaele was with me at the time. We, Raffaele and I, stayed at my house for a little while longer and around 5 in the evening we left to watch the movie Amelie at his house.’

So Knox says they left at 5:00 ““ sticking to her scripted story as she set out in the email home, whilst Raff makes it an hour later.  So, we are led to believe, they didn’t stay in town long at all, and in any case, ”˜I don’t remember what we did’. 

This is a big flag.  When people say, “˜I don’t remember’, they are telling you they recall an event, but are unable to retrieve it from their memory.  In fact, they do not even try, not even when elite detectives are carrying out a crucial murder investigation of your girlfriend’s own roommate.  A person who was not involved will say, “˜I don’t know’ when asked a straight question, not “˜I don’t recall’.

Sollecito sticks to his script: “˜We left via della Pergola, five-thirty to six’:

“˜An amusing thing I remember is that Meredith was wearing a pair of men’s jeans which belonged to her ex”boyfriend in England. She left quickly around 4 pm, not saying where she was going. Meanwhile, Amanda and I stayed there until around 6 pm and we began to smoke cannabis.
My problems start from this moment because I have confused memories. Firstly, Amanda and I went to the centre going from Piazza Grimana to Corso Vannucci passing behind the University for Foreigners and ending up in Piazza Morlacchi (we always take that road). Then I do not remember but presumably we went shopping for groceries. We returned to my house at around 8 “ 8:30 pm and there I made another joint and, since it was a holiday, I took everything with extreme tranquillity, without the slightest intention of going out since it was cold outside.

Note the signifier, informing the reader, “˜it was cold outside’ embellishing the lie, “˜therefore we could not have gone out that night’.

So, whilst Raff on 7 Nov 2007 has jotted in his PRISON DIARY (which of course he is aware the authorities will be reading avidly), they were out between “˜six and eight’, Amanda writes to her lawyers a couple of days later adhering firmly to her script.

Around 3 or 4 Meredith left the house wearing light-colored clothing, and all she said was “Ciao”. She didn’t say where she was going. I continued playing guitar and after a while Raffaele and I left my house, probably around 5pm.
We went to his house and the first thing we did was get comfortable. I took off my shoes etc. I used his computer for a little while to write down songs I wanted to learn for the guitar, I listened to some of Raffaele’s music at this time.

Note the inclusion of irrelevant and trivial detail, “˜I took off my shoes’.  A liar loves to gild the lily.

Then comes Knox’ next written affirmation of what she did the day of the murder:

Here is what I did that night:

5pm: Left my house with Raffaele and walked to his apartment.

5:05pm - ???:

    (1) Used the computer to look up songs to play on the guitar.
    (2) Read Harry Potter in German w/Raffaele.
    (3) Watched Amelie.
    (4) Prepared and ate dinner ““ Fish.
    (5) While cleaning the dishes a bunch of water spilled on the floor.
    (6) We tried to soak up a little with small towels but there was too much.
    (7) Raffaele rolled a joint.
    (8) We smoked the joint together and talked.
    (9) We had sex.
    (10) We fell asleep.

It’s that simple.’

Did you spot, she remembers her lines, despite her problems with amnesia?  Still no mention of going into the old town.  When people use qualifies such as, “˜That’s about it’, or “˜It’s as simple as that’, there’s another flag they have just told you a lie.  Note the triple question mark as if she is unsure it took half an hour to arrive at Raff’s, in case anyone pulls her up on it sometime in the future.  Again bells and whistles, the liar’s toolkit.

Raffaele helpfully offers us an insight in his book several years later as to why he revealed ““ even if Amanda never does ““ they went into town in his police statement of 5 Nov 2007.

From Honor Bound 2012 Andrew Gumbel and Raffaele Sollecito write:

(P 17) It was the last time I ever saw [Meredith Kercher].
Amanda and I smoked a joint before leaving the house on Via della Pergola, wandered into town for shopping before remembering we had enough for dinner already, and headed back to my place.

I mentioned [to police] Amanda and I had gone out shopping, something I had apparently omitted in my previous statements. [note the plural].

So, we see, Raffaele has not voluntarily offered the information “˜we went into town’ either, on the afternoon of 1 Nov 2007.  He concedes he only proffered it, because the police brought it up.  When asked the purpose of the trip, he claims they went “˜shopping’, but on not being able to prove they bought anything nor state which shops the pair frequented, he had to retract this half-lie, by now adding to his 6 Nov 2007 official police statement, later, that once there, they suddenly realised ”˜we had enough for dinner already’.

So, we are led by this to conclude the purpose of the expedition into the old town was “˜shopping for dinner’, when before, it was to “˜to go to my house where we stayed until this morning.’

It is bizarre and a symptom of lying for someone to say they did something, but then didn’t do it, when asked to elaborate.  Raff omits to even mention to police going into the old town, and Knox persistently does not mention it at all.  He only mentions it when detectives ask him why he omitted to.  He then “˜suddenly remembers’ this “˜unimportant detail’ and tells them they were there to shop.  But wait.  They suddenly do not do any shopping at all, whilst in the old town, because once there, they realise they ”˜already had’ provisions for the evening meal.  Amanda Knox makes clear this evening meal was FISH.  Yet she claims she couldn’t remember exactly what she did at Raff’s, for at least three weeks. Fishy indeed.

I don’t know about you, but if I head into town to buy food or clothes, once there, I don’t suddenly think, “˜Hang on a minute, what am I doing here, I already have bread/a dress at home!’ 

Surely, I would buy something anyway, or at least browse around, perhaps use my John Lewis voucher and go for a coffee and cake.

Astonishingly, years later, Knox still deceives us in this matter:

In Waiting to be Heard  2013 Amanda Knox resolutely omits the detail of “˜going into the old town’:

(P61) Sometime between 4:00pm and 5pm we left to go to his place.’

There then follows filler sentences about how “˜we wanted a quiet cozy night in’.

Then comes the type of deception liars love to use: they pad out their tall tales with irrelevant guff.

“˜As we walked along, I was telling Raffaele that Amélie was my all time favourite movie.
“˜Really?’ he asked.  “˜I’ve never seen it’

[Forgetting completely, forensic police discovered he’d downloaded the movie way back on 28 Oct 2007 {by coincidence, no doubt}].

“˜Oh my God,’ I said, unbelieving.  “˜You have to see it right this second.  You’ll love it’

The narrative then completely jumps to:

Not long after we got back to Raffaele’s place, his doorbell rang.  [Enter first alibi Jovanna Popovic, whom Raff states appeared at 6:00pm].

A whole hour is omitted.  One whole hour to get back to Raff’s, just around the corner, four to ten minutes away at the outside.

From all the embellishments, fabrications and outright lies, we see that what happened between 4:00pm and 9:00pm and where the pair went, is significant.  Some say, they obviously went to score drugs.  However, they openly admit to smoking a joint.  In fact, they go to pains to emphasise it.  They have no inhibitions talking about having sex. Therefore, the trip into the old town which took up to two to five hours of their time is rather more sinister than some kind of coyness or embarrassment about buying some dope.

In his statement to police on 5 Nov 2007, Sollecito changes his story and claims he came home alone at ‘20:30/21:00’.  As we now know, the pair both switched off their phones together, between 20:45 and 21:00, so we can be sure this time is supremely salient.  Meredith was on her way back around then.  From Knox not ever mentioning the trip into town, it could be she indeed never did go into town, and that Raff went alone.

Raffaele Sollecito complains in his book “˜the police were out to get me’ by catching out his anomalies.  However, I was watching a tv programme a few days ago, about a murder case, and detectives had to puzzle out from scratch who was the culprit.  The detectives explained to the viewer, when someone comes in for questioning, all they have is that person’s face value account.  They then check out the details, and then, if they discover falsehood and deception in the interviewee’s story, that is what makes them suspicious.  So Raff and Amanda have only themselves to blame police suspected them.

I believe the pair followed Meredith and stalked her movements that night, hence the concealment of their true motive for being out between 4:00 and 9:00.

Popovic has a story that she had to pick up a suitcase from the station, and then didn’t have to after all, so either she really did see Knox at home at six, as claimed, or it was “˜a friend helping out with the alibi’.  See “˜the event that is a non-event’ -type of lie, as above.  Who knows what that was about.  Popovic claims to have spoken to the pair at between 5:30 and 5:45 and again at about 8:40. I personally remain sceptical of her testimony, as I do of his father’s, Francesco, whose claimed account of the 8:42 telephone conversation directly contradicts Knox’ and Sollecito’ with regard to dinner and the pipes flooding, supposedly happening before the murder.

We do know, as James Raper points out, as per Massei - “at 18:27:15 [6.27 pm]  on the 1/11/07, there was human interaction via the “VLC” application, software used to play a multimedia file for a film “Il Favolso Mondo Di Amelie.avi”, already downloaded onto Sollecito’s computer laptop via P2P (peer to peer) some days earlier.”

We also know there was human interaction when the film “˜crashed’ (as it was finished?) at 9:10 because someone clicked on the error message to close it.  I do not think this starting and finishing the film proves anything.  I have always viewed Amélie as a contrived alibi.

Lies can work both ways.  I don’t believe either Francesco or Popovic. The supposed testimony of these two “˜alibi witnesses’ were used directly against Sollecito when his compensation claim was thrown out.

Judge Nencini Issues Harsh Warning To Tell The Truth - So Amanda Knox Does The Precise Opposite

1. Substance Of The Nencini Explanatory Report

The Florence Court of Appeals released the Nencini Motivations Report in Florence one week ago today.

This report explains the rejection of Knox’s and Sollecito’s own first appeal against the Massei trial outcome of 2009. Four years were lost because the Hellmann court, which heard the first iteration of that appeal was bent as Cassation, the competent judge displaced, and now Judge Nencini have all concluded.

The Hellmann outcome of 2011 was mostly annulled, as in “ceased to exist”. The main findings and verdict have zero legal standing, and zero relevance to today’s process though (see below) Knox and Sollecito repeatedly try to ride that dead horse again.

Cassation confirmed Knox’s three-year prison sentence for framing Patrick (for which she has served the time). And Cassation referred the methods and recommendations of the Conti & Vecchiotti consultancy, which Cassation had hammered on legal grounds, to the Florence appeal court for the substance to be reviewed.

Our evidence and law experts here and in Italy have been looking at Judge Nencini’s 347 page report and find it hard-hitting and unequivocally blunt.

It will be extremely hard to appeal against within the very narrow limits Cassation allows. It removes all of Judge Massei’s ambiguities about motives, it reaffirms the witness statements of Curatolo and Quintavalle, and it judicially affirms the validity of the DNA and other forensic evidence against Knox and Sollecito.

There is overwhelming proof of the presence of all three perps, Knox, Sollecito and Guede, in the cottage that night.  Guede is considered to have been brought inside by Knox, who had the only key, and he could not possibly have broken in through Filomena Romanelli’s window in the manner asserted by their defense.

Especially troubling for the defense, the report hints at an illegal suborning of the independent forensic experts appointed by the Hellmann court, and it also hints that the two “supergrass” witnesses, the prisoners Aviello and Alessi, may have been illegally tampered with by Sollecito’s lawyer Giulia Bongiorno, as first claimed 30 months ago.

The report warns that criminal slander of justice officials and other contempts of court will be heavily leaned on.

So the report demolishes the last remnants of Judge Claudio Hellmann’s now annulled acquittal, and substitutes for its fatally flawed reasoning a tightly crafted report that confirms the convictions of Knox and Sollecito.

It confirms that they acted in concert with Guede as Cassation itself long ago concluded had to be the case, and it appears to close any possible argument against the verdict that will carry weight at the Supreme Court.

2. Amanda Knox’s Press-Release Statement In Response

Knox issued a seven paragraph statement later the same day. Maybe not the smartest bit of work.

It is riddled with factual inaccuracies and innuendo, is typically arrogant and condescending in tone, includes the trademark racial innuendos about Italians and the black guy in the case, and shows no signs in its compiling of competent legal help.

Here below we show the various ways in which Knox flouts Judge Nencini’s warning and attempts to mislead. None of what Knox stated was the truth.

Claim: The Hellmann Court Found Knox “Innocent”

I have stated from the beginning of this long ordeal that I am innocent of the accusations against me. I was found innocent by the only court in Italy that retained independent forensic experts to review my case. I want to state again today what I have said throughout this process: I am innocent of the accusation against me, and the recent motivation document does not ““ and cannot ““ change the fact of my innocence.

First even if she was provisionally released following the now-annulled appeal, Amanda Knox was never, repeat never, found innocent. Only Cassation can make that final ruling, and they strongly found against the lower court that had jumped the tracks midway-through.

Even Judge Hellman himself said after his verdict that ‘the truth might be otherwise’ and suggested any reasonable doubt as to guilt has not been categorically and legally dismissed. He seemed to divine that he had failed in his task of bending the outcome in a way that would stay bent.

Second the court that Knox thinks found her innocent no longer exists as a legal fact. It seems to endemically escape Knox that the Hellmann outcome was annulled. Annulled. As in: wiped off the books. It is surprising that even Curt Knox and Ted Simon and David Marriott, while admittedly themselves no masters of Italian law, cannot help Knox to grasp that simple fact. It weakens her to keep clinging to a myth.

One reason it was annulled (and the reasons were overwhelming, one of Italy’s most decisive annullments ever) was that both Cassation and Dr Nencini had good reason to suspect the Hellmann court had been corrupted and had deliberately departed from the evidence and the law. Knox needs to ask herself why the highly qualified Judge Chiari was pushed aside (and immediately resigned in anger) in favor of a wrongly-qualified business judge (who is now ignominiously retired).

Third, it needs to be grasped by Knox that the Conti/Vecchiotti consultancy, far from being legally right and acting independently (and scientifically), was suggested as illegal by Perugia’s chief prosecutor Dr Galati, as appeal judges are forbidden from appointing consultants at that stage. While Cassation passed in ruling on that one, the consultancy outcome was criticised as illogical and legally unsound by both Cassation and Judge Nencini, as biased, full of baseless innuendo about contamination, and possibly tampered with by an American academic hired by the defense.

Conclusion: none of what Knox stated was the truth.

Claim: Only Rudy Guede’s DNA Was Found

The recent motivation document does not ““ and cannot ““ change the forensic evidence: experts agreed that my DNA was not found anywhere in Meredith’s room, while the DNA of the actual murderer, Rudy Guede, was found throughout that room and on Meredith’s body. This forensic evidence directly refutes the multiple-assailant theory found in the new motivation document. This theory is not supported by any reliable forensic evidence.

The forensic evidence is not just the DNA on the knife or in the room. It also includes the extensive traces deposited by Knox in the rest of the crime scene (bathroom, corridor and Filomena’s bedroom), and it also includes all of the autopsy.

Meredith’s room itself was not comprehensively tested for DNA. The room was dusted only for fingerprints, as the investigators had to make a call on prints or DNA.

Guede’s DNA was not found “throughout that room” or all over Meredith’s body. Guede’s DNA was found only in one instance on Meredith’s body, on a part of Meredith’s bra, mixed with Meredith’s blood on a sweatshirt cuff and the purse, and on toilet paper in a bathroom.

Knox’s DNA was found mixed with the blood of Meredith in multiple places, the only known source for which was the pool of blood in Meredith’s bedroom:  multiple prints of Knox’s bare right foot in the hallway and in Knox’ bedroom, and at least five instances of mixed samples containing the DNA of both Meredith and Knox, including in the north bathroom and Filomena’s room, places where Guede did not go.

The court ruled that the blood and mixed DNA evidence found throughout the crime scene places her and Sollecito there at the time of the murder at the same time as Rudy Guede.

Though not DNA, there was one bloody shoe print in Meredith’s bedroom estimated to be Euro size 36-38, compatible with Knox size 37 and with no one else known of who could have left it there.

No fingerprints of anyone were found in the room, just a palmprint of Rudy Guede. Fingerprints were not found even on Knox’s own lamp, which she only confirmed grudgingly at trial was her own, and not found even in Knox’s own bedroom. Overwhelming sign of a cleanup? The courts all believed so.

Conclusion: none of what Knox stated was the truth.

Claim: The Knife As Murder Weapon Was Disproved

The forensic evidence also directly refutes the theory that the kitchen knife was the murder weapon: the court-appointed independent experts confirmed that neither Meredith’s blood nor her DNA was on the alleged murder weapon, which experts also agreed did not match the stab wounds or the bloody imprint of a knife on her pillow.

Judge Nencini’s finding is that two knives HAD to have been involved from both side of Meredith’s throat and the final blow was by a large knife the same size as the one in evidence.

Regarding the large knife, Knox rehashes the same arguments her defense made to no avail before the original trial court that found her guilty. We posted explaining the solid proof here and here.

The only DNA tests that matter with regard to the big knife are (1) the sound finding by Dr Stefanoni that Meredith’s DNA was on the blade - Knox is wrong, the independent experts did not refute that; (2) the sound findings by Dr Stefanoni and the Carabinieri lab that Knox’s DNA was on both the blade and the handle of the knife. None were overturned; contamination was ruled out; and the defense was left without a shot.

The Hellmann-appointed experts confirmed that the genetic profile found on the knife blade was the genetic profile of Meredith Kercher.  The TMB test did not confirm if it was blood, but defense experts were forced to concede that TMB erroneously fails to confirm that blood is present about half the times in assessing minute quantities.

The Hellmann-appointed experts tried to explain away the genetic profile as being the result of contamination, but were never able to identify any scenario by which a knife that had supposedly never left Sollecto’s kitchen contained biological material yielding a clear genetic profile of Meredith Kercher.

Accordingly the Appeals court has ruled the kitchen knife is in fact the one that was wielded by her to strike a final blow, and at the same time there was a second knife in the room used by Sollecito to torture Meredith.

London DNA expert Dr David Balding certified Raf’s DNA as being on the bra clasp. This proves by itself that Sollecito was there. Knox belatedly claimed she stayed at the Via Garibaldi apartment with Sollecito all evening and now and then Sollecito belatedly backs her up. But how could that be if the court has positives of his footprint on the bathroom rug and on the bra, showing he was over at Meredith’s cottage that night? Proof of him present equals proof of her.

The Hellmann-appointed experts were not charged with analyzing the stab wounds, or whether the imprint on a sheet was of a knife or of something else and the result of the fabric being folded - nor was this within their field of expertise.  Defense experts testifying on these issues were in conflict.

Conclusion: none of what Knox stated was the truth.

Claim: The Circumstantial Evidence Is “Unreliable”

In fact, in the prior proceeding in which I was found innocent, the court specifically concluded that the forensic evidence did not support my alleged participation in the crime and further found that the circumstantial evidence was both unreliable and contrary to a conclusion of guilt.

The recent motivation document does not ““ and cannot ““ change the fact that the forensic evidence still does not support my participation and the circumstantial evidence still remains unreliable and contrary to the conclusion of guilt.

Knox appeals to Hellmann’s ruling on the circumstantial evidence being unsound. But the Supreme Court, in annulling Hellmann, explained why it found his arguments illogical, and reminded the court of the standards by which circumstantial evidence must form a coherent whole. Judge Nencini in our opinion amply meets those standards in an elegantly argued report which will be hard to defeat at Rome’s Supreme Court.

Knox herself has proved the “unreliable” one, proven over and over again to be a liar who attests to her own bad memory in written statements, who talks of “dreams her mind made up”, who repeatedly goes vague.

We cannot rely on Knox’s recall of phoning mom, the timing of which moves and sometimes disappears. Knox claims she can’t remember where she was that night, she told a whopper of a lie on her boss, she can’t remember if the door to Filomena’s room was open or closed, she can’t remember her own lamp, she claims she rarely looks at a clock. On and on.

The strongest example of circumstantial evidence Knox can’t shake is the five spots of her DNA mixed with Meredith’s blood. Maybe 2 or 3 spots could be put down to unlucky chance, but five really removes reasonable doubt.

Conclusion: none of what Knox stated was the truth.

Claim: No “Legitimate” Motive Is Identified

And the recent motivation document does not ““ and cannot ““ identify any legitimate motive for my alleged involvement in this terrible crime. No fewer than three motives have been previously advanced by the prosecution and by the courts. Each of these theories was as unsupported as the purported motive found in the new motivation document, and each of these alleged motives was subsequently abandoned by the prosecution or the courts. Like the prior “motives”, the latest “motive” in the new motivation document is not supported by any credible evidence or logic. There is simply no basis in the record or otherwise for this latest theory.

“Proof” of motive is not required in any legal system in the world. The serial misleader Ted Simon should at least admit to that. The motives advanced were not withdrawn or abandoned by successive judges; they were fine-tuned chronologically only within very narrow limits. The sex hazing that went too far was weighted downward and pushed back, and a battle over theft of money was weighted upward and pushed forward.

The court found very compelling evidence that Knox committed the murder and led the pack. It postulates that Meredith and Amanda were incompatible with each other, and that Knox, Sollecito and Guede, high on drugs, first assaulted Meredith, restrained and abused her, and then murdered her with two knives.

Knox was known to be in serious rejection by those she encountered in Perugia for her sharp-elbowed brashness - growing rejection by her flatmates, her employer and the bar customers, and just about everyone she encountered except initially for Sollecito. But soon even he was being given a hard time and has semi-rejected Knox in return ever since. The first words of his 8 November 2007 statement to Judge Matteini were “I wish to not see Amanda ever again.”

And money was a huge looming problem which could have had her back in Seattle in weeks. Knox was known to want to head for China, and was known locally to have an expensive drug habit which had cut her savings in half. She really needed to hang on to that job at Patrick’s bar, especially as she had no work permit.

Sollecito’s bank balance was minimally topped up by his father each month. Francesco seemed to realise cocaine is an expensive habit and didnt want to see his son off down that slippery slope. So with Knox’s own habit, her remaining savings would have run out in weeks. How then to explain to Curt Knox that she really needed a whole lot more? He would have given her a very hard time before any more money flowed.

Conclusion: none of what Knox stated was the truth.

Claim: The Supreme Court Will Allow Another Full Appeal

I will now focus on pursuing an appeal before the Italian supreme court. I remain hopeful that the Italian courts will once again recognise my innocence. I want to thank once again, from the bottom of my heart, all of those””family, friends, and strangers””who have supported me and believe in my innocence.

Cassation wont “once again” recognise innocence. Knox should be encouraged to get real. So should her dummy followers - all her immediate circle know she was involved. There are no obvious grounds for Cassation to second-guess Judge Nencini, a very senior and very respected judge, considering the thoroughness of the Nencini Report. The disjointed series of statements on her blog arguing to the contrary look like the opinions of her friends and fans, not legal minds, and it is time she realizes they have feet of sand and no power to help.

Conclusion: none of what Knox stated was the truth.

Alarm Bells Ignored: Overconfident PR And Lawyers May Have Led To That Shock At Cassation Outcome

Amanda Knox has seemed to us more stunned than confident since she got out of Capanne. Her father mentioned that she was not given the whole picture there.

But we have been surprised in recent weeks at how the defense lawyers and spokesmen and especially Raffaele Sollecito and Giulia Bongoirno and Carlo Dalla Vedova and the PR flunkies were seemingly seeing the Supreme Court appeal as a forgone conclusion in their favor, a blip requiring no change in the end game.

Here are 20 warning bells that we think they might have missed or heard wrongly which contributed to a shocked and ill-prepared reaction to the Cassation ruling, and each of which a team of hard-nosed lawyers not befuddled by PR might have heard and responded to quite differently. 

    1. The Italian media in 2007-2008 in fact did not blow the case and Knox herself out of all proportion. Most of the lurid headlines appeared in the UK press where they had zero effect on the 2009 jury. There really was a hard case to answer.

    2. The British and American media mostly came to be manipulated on the lines Barbie Nadeau’s book described, which meant a big contrast opened up between hard Italian reporting and fantastical UK and US reporting.

    3. The Knox and Sollecito teams shrugged off a short-form trial in October 2008 at which point they might have pleaded that Meredith’s murder was not intended and drugs and mental quirks had resulted in a terrible but unintended outcome, perhaps providing relief both for themselves and Meredith’s family. 

    4. The prosecution part of the trial in 2009 was in fact, contrary to frequent illusory claims, fast and comprehensive and decisive, and it may have been at the end of that phase that the jury was already ready to vote guilty. 

    5. The defense part of the trial was far less successful with Amanda Knox on the stand suggesting to Italians that she was cold-blooded and uncaring, and from then on the defenses were desultory and dispirited with no strong points ever landed. Several days one or other of them failed to show.

    6. The prosecution summation at end of trial was extremely powerful and included in it was a very convincing 15-minute crime-scene recreation video (never released to the public) which accounted for all the marks and stains in Meredith’s room and on her body by an attack group of three.

    7. The Massei report, again contrary to frequent illusory claims later, was considered by those familiar with such reports a model of good logic and reasonable assumptions. It laid out and connected hundreds of evidence points which in a normal appeal process would have been unassailable.

    8. The 2011 appeal did not happen because Massei was riddled with legal errors and wrong assumptions, which would have been the criteria for any British or American judge to agree to such an appeal. It happened solely because, unique to Italy, such appeals are automatic if demanded, resulting in a huge number of appeals on weak grounds. 

    9. Italy does not have a terrible record of trial reversals as some claim. It has a record of fine-tuning and adjustments of thousands of appeals by appeal juries seemingly wishing to prove that they are being diligent. Cassation is aware of this quirky systemic effect, and it often bounces back appeal outcomes to dead center. 

    10. It had appeared that the PR effort was joined by a lot of influential “heavies” including MP Girlanda, Judge Heavey, Senator Cantwell, Joel Simon of CPJ, and the billionaire Donald Trump. Most had limited positive effect in the US and less in Italy, and have been quiet since the Cassation ruling.

    11. Judge Hellmann was a surprise replacement for Judge Chiari, then the able and experienced head of the criminal division. (He resigned over this.) Judge Hellmann, a good civil judge, had very limited criminal-case experience. Chief Judge De Nunzio has not explained why he replaced Chiari .

    12. The scope of appeals is carefully laid out in the Italian judicial code, and they are not to be repeat trials with overall reconsideration of all evidence and al witnesses only absent the careful presentation process and cross-examination at trial. In the US or UK the defense grounds for appeal might simply have been rejected. 

    13. Prosecutor Mignini was provisionally convicted in March 2011 of abuse of office, but careful examination would have revealed that the grounds were spurious and he had no need of a conviction in this case. Cassation in the past month has killed his own case terminally and chastized those who brought it. 

    14. Incriminating DNA was found in Meredith’s room and also outside it in many locations, and also on a knife in Sollecito’s apartment. DNA consultants were “illegally” appointed who muddied the waters but decisively disproved none of it. 

    15. The Supreme Court is on record as deciding that three perpetrators attacked Meredith. The defenses never set out to prove Guede was a lone wolf attacker, for a long list of reasons, and they failed to prove that jailhouse witnesses Alessi and Aviello had pointed out credible alternatives.

    16. The Hellmann-Zanetti report surprised a majority of Italian lawyers who read it for its passion and broad scope and tendentious logic, and for misunderstanding certain key legal concepts. Some instantly saw it as having feet of clay, and a pretty sure candidate for reversal.

    17. The significance of Chief Prosecutor Dr Galati in the process seemed seriously discounted.  UK and US media mostly ignored his appointment and where he came from, which was in fact Cassation in Rome where he was a highly effective Deputy Chief Prosecutor.

    18. The Galati appeal itself was extremely competent and hard line and targeted the Hellmann appeal outcome in several levels or layers in a total of ten points. It is one of the toughest and most sweeping appeals ever filed in Italy, and in the US or UK alarm bells really would have gone off at this one. 

    19.  Sollecito’s book was seemingly okayed by his lawyers, although it causes them major complications in three respects: it introduces new “facts” which contradict his own defense; it derides Italian officials and accuses them of crimes; and it looks like a seedy attempt to make money out of a crime for which the writer is still on trial.

    20. While Sollecito had been acting happily oblivious and super-confident in recent months, he has added to Amanda Knox’s own problems by semi selling her out in his book, and by waking the new 800 pound gorilla of contempt of court prosecutions for not respecting the judicial process.

It may not surprise you to learn that Giulia Bongiorno has not had a very winning record at Cassation, and as far as we know the other lawyers have no experience of winning there at all.

Dr Galati: Here On American TV Tonight Raffaele Sollecito Apparently Commits Felony Defamation

Right now, Raffaele Sollecito, an Italian, is swanning around the United States with the apparent sole purpose of making his home country look bad.

As he is still accused of murder and other felonies until the Supreme Court signs off on the case, and accused felons are normally never allowed to enter the US by Immigration, it seems Sollecito could be here in the US illegally.

This video above was recorded from the Anderson Cooper news program on CNN at 8:45 pm tonight.

Here Raffaele Sollecito claims to have been abused and threatened by interrogators and claims that the same thing happened to Amanda Knox. He implies that he held out for hours, and that Knox was interrogated for 10 hours.

This seems to our lawyers precisely the same kind of invented malicious claim against interrogators which has resulted in both Amanda Knox and her parents being sued for felony defamation (calunnia) by police officers present when she was interrogated.

We know that both Sollecito’s own father Francesco AND HIS LAWYER Mr Maori have just indicated on national Italian TV that Sollecito was lying when he made this and other claims in his book. He has zero evidence to prove it, and he cannot point to anyone who abused him.

Sollecito had more than four years at trial and appeal and on national TV and privately with his lawyers to lodge such charges of abuse - and yet he never did. Not once did he ever advance them even though they might have got him off.

He did not even mention it in his nationally televised interview in Italy soon after he was released. He had to come to America to start making it - as blackmail, to make the Knox forces get him a resident visa?  .

What do we believe really happened?  This is from our July 2009 post on Sollecito’s many alibis.

Sollecito was asked to return to the police station on 5 November to answer some more questions. He was at that time confronted with telephone records that proved that he and Amanda Knox had lied previously.

So for his third alibi, which now cut Amanda Knox loose and implicated her, Sollecito claimed that he was at his apartment all evening, and that for part of the evening Knox was out, from 9 pm to 1 am.

In my previous statement I told a load of rubbish because Amanda had convinced me of her version of the facts and I didn’t think about the inconsistencies…..

Amanda and I went into town at around 6pm, but I don’t remember what we did. We stayed there until around 8.30 or 9pm.

At 9pm I went home alone and Amanda said that she was going to Le Chic because she wanted to meet some friends. We said goodbye. I went home, I rolled myself a spliff and made some dinner.”

He goes on to say that Amanda returned to his house at around 1am and the couple went to bed, although he couldn’t remember if they had sex.

How did things proceed from there? Did Sollecto or his lawyers claim that he had been tricked or abused into a “confession” ? No…

This third alibi was undercut by Amanda Knox when she took the stand and testified. She stated that she was with Sollecito at his place all night.

It was also contradicted by the forensic evidence presented by the prosecution: the four separate pieces of forensic evidence that placed him in the cottage on Via Della Pergola on the night of the murder.

This third alibi was also undermined by the telephone records and by the data taken from his computer.

Sollecito claimed that he had spoken to his father at 11 pm. The phone records showed that to the contrary, there was no telephone conversation at this time, though Sollecito’s father had called him a couple of hours earlier, at 8.40 pm.

Sollecito claimed that he was surfing the internet from 11 pm to 1 am. Marco Trotta, a police computer expert, testified that the last human interaction on Sollecito’s computer that evening was at 9.10 pm and the next human activity on Sollecito’s computer was at 5.32 am.

Sollecito said that he downloaded and watched the film Amelie during the night. However, Mr Trotta said that the film had been watched at around 6.30 pm, and it was earlier testified that Meredith returned to the cottage she shared with Amanda Knox at about 9 pm.

Sollecito claimed that he had slept in until 10 am the next day. There was expert prosecution testimony that his mobile phone was actually turned on at 6.02 am. The Italian Supreme Court remarked that his night must have been “sleepless” to say the least.

This alibi was undermined by the eyewitness Antonio Curatolo, the watcher in the park above the house, who testified that he saw Sollecito there.

From 2007 to 2011 Solleceto was rather notorious for NOT reaching out to Amanda Knox during trial and appeal and for NOT fully supporting her alibi. He has never retracted the statement that she was absent from his house from 9:00 pm to 1:00 am on the night Meredith was murdered.

This may be giving the Knox-Mellases some grins. They despise Sollecito, and they know full well of his treachery toward Amanda during trial when his own lawyer Bongiorno repeatedly blamed Knox (scroll down). They are presumably appalled at his loose lips and dishonest book which mess with her own prospects. . 

the book’s title is a living lie. There is nothing honorable about him. And he is acting treacherously and cowardly toward his own country.

Rudy Guede For The First Time Sort Of Accuses Knox And Sollecito Face To Face

1. Potentially A Huge Day

Tension was really fraught. Everybody involved in the appeal and everybody watching in Italy knew this could be THE day.

Guede had recently lost his final Cassation appeal and in a very hard-line ruling Knox & Sollecito had also been associated with the crime.

He was at this appeal hearing as a prosecution witness, because he had written a letter to the prosecution heatedly denying the claims of a former cellmate, Alessi, that he had said Knox and Sollecito did not attack Meredith with him, another two had.

With seeming nothing to lose, Guede could both deny Alessi’s claim and definitively point the finger of blame at the pair, and thus all three would remain locked up for many years.

2. How The Day Actually Went

Despite a turbulent day in court this was not a shapeshifter event. The problem was that Guede was far too nervous to testify.

He is not normally nervous, but it is rumored that the name of Sollecito’s mafioso Uncle Rocco might have been been whispered in his ear.

So his prison letter was read out for him by the prosecution, and it did include this.

This splendid, marvelous girl was killed by Raffaele Sollecito and Amanda Knox.

Then Sollecito lawyer Bongiorno grew increasingly frustrated in attempting a cross-examination, and Guede ended up barely saying a word. The letter alone is rather diminished evidence.

Amanda Knox and her ex-boyfriend did kill Meredith Kercher, a man who was also convicted of the 21-year-old’s murder has told an appeal court.

After Rudy Guede confirmed he believed the US student killed her British housemate, Knox jumped to her feet saying she was “shocked and anguished”.

The hearing in Perugia is the first time that all three defendants have given evidence on the same day.

Knox, 23, and Raffaele Sollecito, 26, are appealing their convictions.

Miss Kercher, of Coulsdon, Surrey, was found with her throat cut at her Perugia flat after what prosecutors claimed was a sex game taken to the extreme.

Knox is serving a 26-year sentence for Miss Kercher’s murder while her Italian co-defendant and ex-boyfriend, Sollecito, was sentenced to 25 years.

Guede told the court that claims by a fellow prison inmate that he thought Knox and Sollecito were innocent were not true. He said he never made that claim to the inmate.

On 18 June, convicted child killer Mario Alessi told the appeal Guede had confided that Knox and Sollecito were innocent.

According to Alessi, Guede said he and a friend went to the house Miss Kercher shared with Knox with the intent of having sex with Miss Kercher and that when she refused, the scene turned violent and his unnamed accomplice slit her throat.

Drug-dealer Guede was jailed for 30 years for the sexual assault and murder of Miss Kercher after a separate fast-track trial. His sentence was reduced to 16 years on appeal.

Guede was in the witness stand as a letter he had written in response to Alessi’s claims was read to the court on Monday.

“This splendid, marvellous girl was killed by Raffaele Sollecito and Amanda Knox,” the letter said.

Guede has previously admitted being in the house at the time of the murder, but denies involvement in Miss Kercher’s death.

After cross-examination by the defence, Guede said he had always believed Sollecito and Knox were behind the murder.

“I’ve always said who was there in that house on that cursed night,” he told the court.

Knox stood up after Guede’s evidence and denied his claims.

“The only time that Rudy Guede, Raffaele and I were in the same space has been in court. I’m shocked and anguished.

“He knows we weren’t there and have nothing to do with it,” she said.

Sollecito said Guede was always talking “about a shadow that could be me and a voice that could be Amanda’s… we’ve been fighting shadows for four years. Our lives have been destroyed in a subtle and absurd way.”

Speaking before Monday’s hearing, Knox’s mother Edda Mellas told reporters she hoped that Guede would have the “integrity to stand up and tell the truth”.

She said her daughter was “always very anxious and nervous but I think she’s glad things are moving along. She feels things are going well,” but that it is, “hard to get too hopeful, especially after the first trial.”

Two other witnesses were called to counter claims made by another defence witness, a member of the Mafia named Luciano Aviello, who had told the court earlier this month that his brother - who is on the run - had killed Miss Kercher during a botched burglary.

The two witnesses - two inmates at the same prison as Aviello - testified that Aviello had said he had been contacted by Sollecito’s defence team to stir up confusion in the trial in exchange for money.

Witness Alexander Ilicet said Aviello had wanted the money for a sex-change operation.

4. Andrea Vogt For The Seattle PI

As if the appeal wasn’t bizarre enough, two convicts were called by the prosecution as counter witnesses Monday to contradict several inmates called by the defense earlier this month.

They maintained they had overheard in prison conversations about a plot among other inmates to testify in exchange for money and benefits, such as reduced prison time.

The person they heard was arranging things, they said, was Sollecito’s attorney, Giulia Bongiorno, who heads up Italy’s parliamentary justice committee.

She forcefully denied the corruption accusations in the break afterwards and vowed to file charges and take legal action against her accusers.

One claim by the inmates was that Bongiorno offered a sex change operation to Luciano Aviello. It would be helpful if some of this if it exists emerged on tape. What possible reason would they have to lie?

5. And So To The Bottom Line

Along with Judge Hellman’s increasingly evident bias, and the smoke being blown over the DNA, and the Sollecitos and Bongiorno not (at least not yet) investigated by the judge for alleged witness bribes, not to mention Uncle Rocco’s power to alarm even by whispered mention of his name, the Knox and Sollecito defenses are down, but not yet for the count.

This for the first time on Guede’s side (but not on Knox’s or Sollecito’s side) crosses a public boundary between the three.

The DEFENSE Not Italian Officials Leaked About Knox HIV Test In Capanne DRAFT

The several wrong facts in the Lifetime movie,  especially of timeline, perhaps balanced one another out, and seemed to leave many viewers sensing the possibility of guilt.

However, there was one very serious wrong claim in the movie and in the following documentary which implied criminal action on the part of the Capanne Prison medical staff and prosecutors and may have aroused a lot of false sympathy for Amanda Knox.

The film depicted Amanda knox being told by the doctor at Capanne that in a routine test she tested positive for HIV and to write down a list of her previous partners. Later, a confrontation was shown between an angry Amanda and the doctor (which never happened) when he told her she was all clear.

In reality, the doctor told Amanda at the start that the test was probably a false positive and that she shouldn’t worry and that another test would be run. The doctor never instructed Amanda to write out a list of her previous partners. And the prosecutors never leaked that list.

In Amanda Knox’s own words, you can read above how it went down: She chose herself to create the sex partners list.

The myth in the movie of how the sex partners list was created and spread around was then later compounded by the ‘Knox friendly’ Lifetime documentary. That also claimed Amanda Knox was told to write down her list of partners by the doctor and then her diary was leaked by prosecutors to the public.

We know this to be false. We know that it was instead Amanda Knox’s own lawyers that leaked the diary with the sex partners list (to journalists like Barbie Nadeau) and the family effort that leaked it to people like Frank Sfarszo (who duly published Amanda’s diary page on previous sexual partners), and Candace Dempsey, and even tried to leak it to us!

Amanda’ Knoxs family know the truth of this, but have not yet come out and corrected a seriously wrong pervasive impression. And Lifetime repeated the lie of the sex partners list, leading millions to believe the ILE deliberately terrified, tricked and humiliated Amanda Knox.

But they didn’t. Amanda Knox herself showed it was not so.

1. Movie Advances HIV & Sex Partners List Hoax

The Lifetime movie nicely depicted Meredith and Dr Mignini, and was not tough on Knox, though it seemed to leave many viewers sensing the possibility of guilt.

However, there were several seriously wrong scenes in the Lifetime movie, and also in the associated Lifetime documentary. Two scenes advanced the HIV-test and sex-partners-list hoax.

    1. In a first long and emotional scene, the film depicted Amanda Knox being told by the doctor at Capanne that in a routine test she tested positive for HIV. It implied the test was a form of pressure. It showed Knox being told she should write down a list of her previous partners.

    2. In a second long and emotional scene, the film depicted a confrontation between an angry Amanda and the doctor when he told her she was all clear. And thereafter depicted that it was the the prosecution that leaked the sex partners list.

These implied criminal actions on the part of both the Capanne Prison medical staff and the prosecutors, and aroused a lot of false sympathy for Knox.

2. The Hard Facts About Knox’s HIV Testing

1. Lifetime V Reality: Knox Had Herpes When She Was Tested

Lifetime simply depicted Amanda Knox being told by the doctor at Capanne that she tested positive for HIV. It implied the test was unusual.

In fact, on her admittance to Capanne Prison, Knox was simply routinely tested for HIV and some other possible conditions, as all prisoners are, for their own good.

Knox had herpes at the time, visible on her lip in many photographs, and herpes can result in a false positive result for HIV.

2. Lifetime V Reality: Proof Knox Warned Positive Test Maybe False

Lifetime did not depict Knox being warned about false positives. But Knox’s diary reads:

Last night before I went to bed I was taken down to see yet another doctor who I haven’t yet met before. He had my results from a test they took which says I’m positive for HIV.

First of all the guy told me not to worry, it could be a mistake, they’re going to take a second test next week….

3. Lifetime V Reality: Knox Herself Creates Sex Partners List

Lifetime claimed Amanda Knox was told to write down her list of partners by the doctor.

But in Amanda Knox’s own words, you can read how it went down: She chose herself to create the sex partners list. The doctor never instructed Amanda to write out that list. Her diary reads:

Thirdly, I don’t know where I could have got HIV from. Here is the list of people I’ve had sex with in Italy [strike Italy] general:...

4. Lifetime V Reality: There Was No Angry Confrontation

Lifetime depicts a yelling, pointing Knox, who has to be restrained.

The doctor merely conveyed the news of a negative results and Knox cheerfully went off. He had no ill intent, she did not get angry, and no accusations were made.

3. The Hard Facts About Who Leaked The Results & List

Lifetime implied that Knox’s diary with the list of partners was leaked by the prosecutors to the public.

We know this to be false. We know that it was instead Amanda Knox’s own lawyers that leaked the diary with the sex partners list (to journalists like Barbie Nadeau). And that the family effort leaked it to people like Frank Sforza (who duly published Amanda’s diary page on the previous sexual partners), and Candace Dempsey, and even tried to leak it to us!

Amanda’s lawyers leak like sieves, always have, and they’ve rarely, if ever, asked Amanda permission to do so. It isn’t actually required, since she’s already given them permission to act on her behalf. In a way, it’s a bit like electing a politician. Once you’ve elected them, they don’t have to come back to you (the electorate) for permission every time they want to pass a bill, create a new policy or enter into negotiations.

When we had our own reporter (Stewart Home) attending the trial, the defence happily showed him anything in the case file he asked to see. In fact, many times they offered without his having to even ask.

In addition, Amanda’s family have been doing quite a lot of ‘leaking’ themselves. Frank Sforza and Candace Dempsey got most of their data from them, as did Charlie Wilkes, Mark Waterbury and Bruce Fischer. And this leaking by the family started long before the trial.

It needs to also be pointed out, Sollecito’s family and lawyers have also been doing their share of leaking.

However, the Knox family and their followers have been only too happy to publicly blame all this leaking on Italian law enforcement (ILE) and cite this as another injustice against their daughter. The US media have been only too happy to carry these accusations, without question. This is how the ILE have been framed and it stinks.

The Vilification Of Prosecutor Mignini Clearly Continues To Misfire

In this recent post we included an amazing statement from Mr Mignini.

A number of sources then confirmed that he and we had it exactly right in that post and that the claims of the American writer of the lurid “Monster Of Florence” are nasty, mischievous, and simply don’t check out.

Sources tell us Mr Mignini may have sharp elbows - but he is also very fair and careful, rarely leaks or does anything just for the publicity, does a great job for Perugia (where he is rather popular), and really respects the victims of crimes and and their families - in this case, Meredith and her family who repeatedly sound like they respect him.

Now La Nazione is reporting that Mr Mignini is again aggressively fighting back against the so-far-fruitless campaign to vilify him. 

He is planning to sue a Joe Cottonwood, seemingly a publicity-hungry carpenter and occasional journalist in California whose knowledge of the case would apparently not even cover a postage stamp. And who seems to feel he has a license to shoot his mouth off slanderously in Italy, regardless of who actually gets hurt.

The publisher of his uninformed take on the case in Il Giornale will apparently also be sued,

According to the American writer [Cottonwood] among other things, “perhaps in Italy there is a hatred of American college students who give joy to madness. Amanda will pay not for her guilt or innocence, but because of popular resentment towards rich and superficial Americans. The murder of Meredith Kercher is one of those mirrors that reflect the prejudices of the investigators.”

The last time that the prosecutor had moved for legal action was in January, when the West Seattle Herald described him as “inadequate” and “mentally unstable”. In that case, in a move that many had regarded as completely understandable as well as justified, the prosecutor saw fit to start concrete legal action.

And now the same judge [Mr Mignini] is preparing for a new legal battle after suffering yet another attack from the disparaging “‘stars and stripes”. Mr Mignini and his colleague Manuela Comodi are preparing an indictment for after the conclusion of the trial, which resumes in mid-month this month.

Nice going by the fatuous Joe Cottonwood. For those of a less xenophobic frame of mind here actually is the evidence. A series still far from complete.
