US Measures Available To Italy To Secure Wrongdoers Without Argument

The post just below described in part how the twin justice systems are stacking up against the perps.

For Amanda Knox there are not one but three more ways in which the legal landscape is more tilted against her.

First, Bongiorno and Sollecito are clearly going for a “get-out-of-jail-early” tactic coupled with a “I-never-bought-into-a-murder” tactic. They dont seem to be maliciously dropping Amanda Knox in it, but they are sure signaling that it’s every perp for themselves now, and that fighting a legitimate system and process is going nowhere.

Second, even before filing a request for extradition, Italy can request Interpol to issue a worldwide Red Notice for her capture. A Red Notice instigated by Italy is what got the CIA operative Robert Lady scampering out of Panama and experiencing a miserable life on the run thereafter - so much so that he has actually talked about suing the United States government (unlike Knox he had a contract).

Third, working through the United Nations body in Vienna that advances and harmonizes national justice systems, Italy and the United States and other closely aligned countries have arrived at these supportive legal arrangements for the enforcement of verdicts in one another’s countries.

See page 61 onward for the help the US offers. In effect, upon Italy’s Ministry of Justice filing the application, the American Department of Justice (with the FBI, just across Pennsylvania Avenue, and the Federal Marshals as its enforcement arms) would pick up the responsibility for tracking down the millions Knox would seem to owe

[Page 66] Enforcing Order to Seize Criminal Proceeds:

Under U.S. law (Title 28 United States Code Section 2467), the United States has the ability to enforce foreign restraining and forfeiture orders pursuant to an MLAT request or pursuant to requests made under certain multilateral conventions, including the 1988 Vienna Convention, the U.N. Convention against Corruption, and the U.N. Convention against Transnational Organized Crime. The crime for which the property is to be restrained and ultimately forfeited must be one that would subject the property to forfeiture under U.S. law, had the underlying acts been committed in the United States. To restrain the assets, the requesting country must provide in the MLAT/convention request a copy of the restraining order from the requesting country’s court that specifically identifies the assets in the United States to be restrained, or in the alternative, an order which restrains all of the assets belonging to the accused…

The relevant US body is this one: Office of International Affairs, Criminal Division, United States Department of Justice, 1301 New York Avenue, N.W., Washington, D.C. 20005 (not in the DOJ main building below).

Freezing all of Knox’s assets till her dues are paid would mean no credit cards, no cash, no way to pay lawyers, no way to buy food or clothes or pay rent, no way to pay for internet use and a cellphone and trips, and no way to present a clean credit record to any prospective employer so no income coming in. 

If it doesn’t come to that, it will be because those who can guide Knox step in now to break it gently and get her to do the right thing.

The wheels of justice move slowly but surely.

I wish you could also tell her the quality of life in American prisons. But when the bad times come, people invariably make the worse choice, if left to themselves. She is obviously not listening.

Frankly speaking, I have more sympathy for Robert Lady.

Good question Cardiol. And Chami has a good point - two good points.

It looks like Italy’s response will be defined by the Knox-camp reaction after Cassation rules, if no white-flag signals are put out before that. They watch and wait.

The arrogant Knox email to Judge Nencini proved a really bad idea as was her arrogant statement after the Nencini sentencing report came out. We may not see more of that; especially if they show the addled Steve Moore the door.

If Knox sensibly follows in the emerging tracks of Sollecito, as the post suggests she might now be encouraged to, then none of these “battleship” measures (of which there are a lot) would need to be deployed.

The Italian system has come to be designed to face down much tougher perps than her, and if she lived in Italy she’d long ago have been getting good advice, as Sollecito is now.

The US never got an official request to extradite Robert Lady and the “failure” was back in Italy where simple “guilty” verdicts were punishing the CIA group anyway. But that Red Notice was put out, and Panama and Costa Rica where he temporarily fled were seemingly getting ready to round him up.

The US didnt round him up when he arrived back (if he arrived back - he was said to have never got off the plane) but they sure cold-shouldered him otherwise.

In that he says he was against the snatch of Omar, and had repeatedly been told extraordinary rendition was within the American law.

Knox would need a massive amount of political support to do better than Lady. At the FOA performance in a public room of Congress Senator Cantwell did briefly appear but scuttled out the door the first chance she got, and not one other politician or any of their staffers came to hear Heavey, Moore and Douglas (three retired law-enforcement wannabees).

The entire point that the FOA has either ignored or dismissed is that Italy has been stung by the anti Italy movement of the FOA. Therefore the Italian Justice system will leave no stone unturned in order to establish their right as a sovereign nation to enforce it’s own laws

I predict therefore that Italy will be very careful to get all of this right, including a ‘Red Notice’ They will be more than careful concerning any loopholes the FOA and therefore some judge with a restraining order etc;

Egotistical and uneducated persons such as Bruce Fischer and Amanda Knox believe they can do whatever they want. They think that just because they believe things to be so that they are indeed true. (Son of Sam Laws for example) As you say it’s every man/woman for themselves. It is my sincere wish that some good and some closer comes to the Kercher family.

There have been many interesting developments in the case recently. The long awaited separation of Sollecito’s defense from Knox is complete, with Bongiorno’s request for his case to be heard by a different court (the Unified Sessions)than hers being just one of many steps (I don’t think it will be granted, BTW)

The Sollecito family seems to be releasing many of the case files to friends in the media. Much of it was reported earlier, but the timing of the new reports are curious to say the least.

It looks like a two fold strategy: undermine Knox’s support at home, paint him as an accessory after the fact and try to get him to jail without any further fuss so he can be released on probation within ten years or so.

A strategy that Amanda Knox seems unwilling to choose, to her detriment.

Perfect. Sforza and the Moores and Fischer demonizing all of Italy (they are still at it) has done Sollecito nothing but harm. It was in 2012 that they got their hooks into him and wrote his book for him. Their agenda should no longer be his agenda, and Bongiorno seems to be insisting on that.

This strategy does involve pushing Knox forward as the only one with motive for stabbing Meredith and a cleanup. All judges bought into that one even though the Massei scenario (that Guede set the attack rolling) was pretty strange.

Knox forces can rant all they want but its not malicious on the part of RS because he leaves her a way forward which would be similar to his. She cant deny the final blow, or get the same sentence as him, but she can show major contrition (as Guede did) which would help her in turn.

One reason for the Italian hard line which few know and others forget is that the trial was partly conducted behind closed doors and the terrible cruel sadistic nature of the attack (a classic jealousy/revenge attack which these foolish ex-FBI profilers try to hang on GUEDE can you believe?!) gave jurors nightmares for weeks.

This clincher at trial told the defenses that by normal legal roadmaps they were cooked. So furtively they invented their own.

Hi, Peter, I’m pleased to tell you the Knox camp is in total disarray

Bruce Fischer was caught with an outright lie on his website “no one is attacking anyone” though we had dozens of screen captures of Michelle Moore’s tweets to Raffaele Sollecito and outright threats. She deleted them overnight, but we saw them anyway 😊

Then Steve Moore wrote an incoherent blog urging Raffaele Sollecito to do the right thing while at the same time attacking his aunts and sister Vanessa. Needless to say, they know, and are not amused.

Then to double down, he accused Raffaele DIRECTLY, of “statements and non-statements”. All written up here

Hi everybody, looks like whatever Sollecito/Bongiorno are doing is too late anyway ... right?

This little murderous effer had all the time in the world to speak up (both from a legal *and* a moral standpoint), and he didn’t.

Nothing short of a full confession *with verifiable information* is acceptable at this point, which by the way should not change the sentence itself, so I am wondering what in the heck are the Sicilian woman and her gullible client thinking?

Whatever “strategy” they are considering, it’s already water under the bridge, they did not present new information within the court-imposed legal window, so isn’t whatever they do now (like the infamous press conference a few weeks back) basically futile?

Yeah I’d day you are quite right (and funny with the Sicilian reference, she is from there and does attract an unsavory clientele).

The Supreme Court ratification of the Nencini appeal court verdict and sentence is a sure thing.

The interpretation in the post - the take from informed sources in Italy - is that he is actually speaking right past the court.

That he’s getting this on the record now, to be considered years down the road, while it doesnt just sound like jailhouse-lawyer talk which the world heard plenty of previously from his cell.

The notion that he did not delver or intend the final stab might be true. But the voluminous evidence sure has him pinned down there.

Any idea how many read Moore’s blog? It is highly offensive to the real Italy and Moore seems to be a glovepuppet now for some very unsavory forces.

We know threats and hate messages have been received in Italy and I start to be concerned. He needs a big shot across his bows.

The Moores and Ficher aside. It is my belief that Amanda Knox is insane. She has a low level of cunning and cleverness which can best be viewed by her performance upon returning to Seattle. There are of course many others such as her interviews. She exhibits all the symptoms of insanity but just like Jodi Arias she is her own worst enemy.

Over time she has improved her ability to lie out of hand of course without actually spilling the beans. Such phrases as “I did not kill my friend” She can say with a straight face since that is not a lie. After all Meredith was never her friend.

No! Knox is insane and although she does not realize it she is alone and will always be so. Perhaps her Grandmother Elisabeth Huff still believes in her, but this will also come to an end because her supporters (such as they are) are starting to make excuses for her. That is if they really care about her at all since to them it has become a game which they want to win. In other words Knox has become just a figurehead and nothing else.

In that regard some of the comments coming from the FOA are laughable since when they are outmaneuvered into a corner they simply use either invective or refuse to actually answer the question. A good example of this is the famous break-in and subsequent cover up, or to quote the question.

“If Rude Guede left all kinds of DNA then why wasn’t there any DNA of his in the bedroom since he was supposed to have broken is there?” a stupid statement since all he had to do was walk in the front door. But enough of this FOA nonsense which is a waste of time.

I have mentioned before that Knox may consider getting pregnant as a final ‘Hail Mary’ attempt not be extradited. If that were the case then she is doomed to disappointment since Capanne has very good post natal services. Poor kid though.

Lastly as an open letter to Michelle Moore. “Keep those nasty tweets against the Sollecito’s coming” I wonder who deleted them? Could it possibly be that embodiment of crime fighting prowess Steve (the wonder horse) Moore? bet we will never know.

Very interesting. Even before extradition a Red Notice could freeze Amanda’s assets? That would deffo garnish the wages of crime, maybe force her to repay Patrik or enforce the financial judgements against her to Kerchers, civil judgments for big Euro?

If a Red Notice did freeze her money it would reduce her to handouts of pocket change from family and a chickenfeed lifestyle back to being a kid again. Ouch. Her future book proceeds would be withheld from her or publishers shying away. What about the job she recently announced with a publishing house in New York? Will they be paying her with a free apartment and food instead of a check? Edda could be Amanda’s unpaid CPA for life juggling all her bills. If family funds her fugitive run they could end up charged for aiding and abetting.

Bleaker and bleaker. Knox’s discouraged supporter Steve Moore reveals his despair in the photos on his gmancasefile blog. They include tanks from Tianenman Square where students were suppressed, a man covering his face with both hands and weeping, Raf in a black coat, and Martin Luther King who was assassinated. Did Moore imply the initials MK not MLK? Although King himself was killed, his movement did prevail so perhaps MK now controls the microphone.

Moore’s most recent photo is of Amanda in green coat behind bars in the prison van. It’s the same photo the National Enquirer used on their story of August 12, 2014 with headline: TOLD YOU SO! FOXY KNOXY’S DRUG HELL in which Enquirer brags that they exposed Knox’s drug scandal long before Giallo did. Then Moore touts the new book titled “The Forgotten Killer” about Rudy Guede. It has 7 authors, Preston, Heavey, Moore, John Douglas and others. Sounds like more authors in it than truth. I wouldn’t let MII (Moore investigations international) investigate my lost goldfish.

On separating Knox from any gains and paying all required in judgment, it looks like yes (not maybe) to all of the above.

We have looked at them many times before, but still, I have never seen anything as peculiar as the Moores song and dance act. His job at Pepperdine University was protecting Pepperdine co-eds from murder, not protecting a non-Pepperdine co-ed who did murder - and yet, he wondered why he got run out of there on a rail.

One of the greatest jobs in the world is working for the federal government. The perks alone are well worth it. indeed it is a far better job than just about any other since it comes furnished with free medical dental plus liberal time off and the opportunity to travel usually at cut rate prices.

The best thing by far of course is the pension at the end of it all, ask any politician. Once a person is qualified with time in then the money just rolls in. It’s even indexed to the cost of living increase.

The point is the longer you stay in your government job the bigger the pension since you will continue to get promoted by just outstaying others in similar positions. Once you have been promoted the government will keep on promoting you because to do otherwise would mean they had made a mistake in the first place.

Which brings me to the overweight and out of shape Steve Moore who (Unless he has had plastic surgery) would appear to be about fifty years old or in that ball park. Then of course there was Pepperdine university which he was fired from.

So the big question is, why did Steve Moore leave the FBI? Simple he was so good at his job that they kept on moving him to other locations. They do this because it’s better PR than firing him. By his own web site he says he was in charge of the joint terrorism task force in Los Angeles. It also states that he was trained as a sniper. How lovely.

So therefore given his self proclaimed high profile job and age then he should have been promoted to a higher degree in the FBI. So therefore his assertions that he held such a high office is pure bullshit. So he left all of that security plus all the perks (Free Medical, Free Dental, Time off, Huge Pension etc;) to get some measly little job as a security guard at a university? Something smells here and I believe it’s Steve Moore who by his own admission can’t take the heat but will come to a conclusion without any information whatever.

Thank you for pointing out the hidden truth behind Moore. Your analysis is correct. You have a good understanding of the employment system in the United States. Why didn’t (or hasn’t ...) any journalist ever asked Moore why the FBI terminated him.

I had always thought he was a middle-level paper-pusher, far from the field and farther from the top. What did he do wrong, to cause him to lose his career? I don’t know, but his tone corroborates the presence of a problem.

We may one day find out why this main slobberer over Knox got pushed out of the FBI and without lifting one little finger of our own. My guess is Grahame is on target or very close.

He falsely depicts the Italian equivalent of the FBI. They dont appreciate him one bit and they will share their concerns with the US FBI etc if his rants dont stop when the final verdict comes down.

In the first post we ever did on him, it described how he didnt even realise he was impugning the central police.

Note that even defense counsel Ghirga thoughty Steve Moore was what the British call a twit. Nobody in Italy respects him at all.

He went to Perugia with his wife, who lunged at Dr Mignini and was frogmarched off by the Carabinieri; if she tries that again she’ll be needing a file in a cake to come home.

He spoke and speaks no Italian and was not even around during the trial. He is not specialised in any investigation field. He has never been near the Perugia central police station, or asked anyone even one question there. The idea that tagteams interrogated Knox was made whole in his so-called brain.

Talking of “main slobberer over Knox” we were extremely amused when after Knox came back at the end of 2011, Moore attached himself to her like a leech as her “security detail” and within days the Knox-Melllases gave him the push.

(Later main slobberer Sforza got the push too.)

It has been well established as to why Sforza was given the push. So why Steve Moore? Could it be the same reason? ‘The best truth I can think’ is that it’s in the same ‘ball park’ (pun intended)
Fischer seems to whirling around like a mad dervish trying to make excuses for Sforza and in spite of his admission that Steve Moore made mistakes has remained with him throughout. The latest nonsense is that Guede murdered another girl in Greece….....Hmm news to me.

No! All this attraction with Knox has a sexual element about it and given Michelle Moore’s predilection for playing Momma the sexual attraction would not seem so far out of the question. Then there’s Madison Paxton who name has also been attached to Knox from a sexual point of view. Perhaps that’s not correct but given Knox history I do not believe that she was/is fussy about who she has sex with, at least from a gender point of view. Such is the view of the mentally challenged. She will do quite well in Capanne what with one thing or the other.
