Because of extreme mishandling of evidence and the hysterical and quasi-religious delusions of the prosecutor, the idea was planted that more had to have happened to Meredith than actually happened, and her parents were baffled when the killing turned out to be more “ordinary” than at first projected. Meredith surprised a local wastrel who had broken into the apartment she shared with three other girls. He expected that no one would be home the night of November 1, the day after Halloween and a holiday in Italy, and that cash would be around due to rents coming due at the first of the month in the student-saturated city. He then attacked, raped, and killed her. Awful, awful enough, but no sex orgy gone awry.

There is zero proven mishandling of the evidence. The prosecutor was highly professional and had zero quasi-religious delusions. At trial in 2009 the prosecution presented it implacably. Iannone makes things up here. Guede was not a wasterl. He knew nothing of any rent money. There is no way he could have done it alone, the evidence for two others is overwhelming. The defenses tried and failed at the annulled appeal to prove that the two others were not Knox and Sollecito.

The Kercher family is locked on the idea that Knox and Sollecito are guilty, says Heavey, and once people have their mind locked on something, it’s very hard to change. “It’s a thing called confirmation bias. It’s a thing that we all have when we believe something, it’s very hard to shake it. It doesn’t matter how many facts that you tell them,” says Heavey.

That is absolutely not what happened and Amanda Knox on the stand admitted it. She admitted she was treated well and given refreshments. She did a u-turn on her alibi of the moment for one reason only. She had just been told Sollecito had changed his story in an adjacent room when confronted with phone records, and Knox had made him tell lies. The police had no idea whose phone numbesr were on her phone. Knox’s interrogation was voluntary, and as a witness there was no requirement to tape her. Burliegh’s charge here is the same criminal defamation Knox and her parents are separately accused of by those they defamed.

She added that her identity was lost in the media frenzy after Kercher was found murdered at their apartment in Perugia, Italy in 2007.  Knox’s seemingly bizarre behavior - joking around and kissing her Italian boyfriend Raffaele Sollecito, who was also convicted of the murder before he was acquitted - made her prime suspect.

Incorrect. What made Knox a prime suspect was her ever-changing story for no obviously innocent reason which stood out sharply from those of all around her. “Facts” were being adjusted on the fly as she gained new information. Plus her behavior when Meredith’s body was discovered, and her phone records which showed she called her mother before this happened,  and being locked away to call the police with Sollecito when in fact they were already there.

A.D.R. Amanda know about two weeks. From the same evening when I met her she started to sleep at my house.
A.D.R. The day November 1 U.S. I woke up at about 11.00, I had breakfast with Amanda then she came out and I went back to bed. Then about 13-14 hours I reached her house. In fact there was also Meredih. We had lunch together and I while Amanda Meredith has not
ate with us.
A.D.R. Meredith towards 16.00 is out hastily without saying where he was going. Me and Amanda
we remained at home until at approximately 17:30 to 18:00.
ADR We came out from the house, we went into the center, but do not remember what we did.
ADR, We were in the center from 18:00 until 20:30 / 21:00. 21:00 I went to my house alone, while Amanda told me that she would go to the pub Le Chic because
wanted to meet his friends,
ADR At this point we said goodbye I headed to my house while she is direct
towards the center.
A.D.R. I went home alone, I sat at the computer and I got high. Certainly I had dinner but can not remember what he ate. At about 23.00 pm he called me, on ‘user 075.9660789 stares of my house, my father. In fact I remember Amanda yet
had not returned.
ADR I sailed to the computer for about two hours after the call from my father and I stopped
only when Amanda came back presumably at approximately 1:00.

ADR remember that we went straight to the kitchen, we sat down, and we talked for a while ‘, perhaps we had breakfast. In fact Amanda told me that when she arrived at her house she found the front door wide open, and traces of blood in the small bathroom and asked me if it seemed strange. I answered yes and I also recommended to call her friends. She told me she phoned Filomena, while Meredith said he did not
answered.
ADRVerso 12.00 we came out of the house, along Corso Garibaldi, we arrived at Piazza Grimana, then we went to the parking lot of St. Anthony and arrived at the home of
Amanda. To make the journey it took us about 10 minutes.
ADR soon as we arrived she opened the door with the keys, I went inside and I noticed that the door of Filomena was all wide open with the glass on the floor and his room was a mess. The bedroom door Amanda was open and I noticed that everything was in order. Then I went to the door of Meredith and saw that it was locked, before doing this I looked to see if it was true what I had told Amanda about the blood inside the bathroom. In fact, I entered and I noticed that there were drops of blood on the sink and on the mat instead I noticed that there was something strange, a sort of mixed water and blood, the rest of the bathroom was clean.
A.D.R. I went into the kitchen I saw that everything was in order, then I walked around the rest of the house, went to the room of Laura and I noticed that everything was in order. Just then Amanda entered the big bathroom, adjacent to the kitchen, and came out scared and hugged me stronger, telling me that before, when he took a shower, had seen the feces within the
water, but now the water was clean.
ADR I just had a quick look inside the bathroom, trusting what I was saying
Amanda.
A.D.R. At that point I wondered what was going on, I left the house to look for the bedroom window of Meredith to see if I could climb. I went outside along with Amanda and she tried to climb, I have immediately blocked telling her not to do it because it was dangerous. Then I told Amanda that the best solution was to break down the door, I tried to kick and shouldered, but I could not open it. Then I called my sister to the phone and I have advised on what I could do, she being a Lieutenant of Police. My sister told me to call 112, which I did, but in the meantime came the Police
Zip.
A.D.R. I have reported in the previous report of shit, because she had convinced me of his version of the facts and I have not thought about the inconsistencies. I heard the first statements that he
made to the Postal Police, intervened on the spot.
A.D.R. She usually always brings with it a large bag that also had the evening of November 1.
The tax inspectors acknowledge that the record is closed at 03:30 on 6 November 2007. ‘

REAL KNOX Monster

Dr Mignini was not talking about morals or about all women.

He was being purely practical and was in fact explaining how Italian girls keep themselves out of trouble and Knox could have done so too, in which case Meredith would still be alive.

People who came to the case from 2010 onward have no idea how mixed up and dangerous Knox was. She didnt only allow rockthrowing at Seattle U, she was a proven serious dopehead as well.

Very very few spoke up for her in Seattle after her arrest. 

Netflix never mentioned that.

She headed for Perugia why? Because it had then the reputation for the easiest drugs of any university town in Italy? 

Netflix never mentioned that.

Solid surveys by American colleges worried about their exchange students abroad have studied foreign drug scenes and found

(1) drug intake and alcohol intake often jumps 50 percent;

(2) students on psychological medication as psychologists suspect Knox might have been often come off their meds and crazy situations result.

Every year a bunch of overseas students get charged with crimes.

Netflix never mentioned that.

That is why they DEMAND to fund and supervise official exchange students - which is probably why Knox was not. She was the 1 in 100 Amrican students totally freelance.

Walking a highwire without a net.  Netflix never mentioned that.

She was bad news to EVERYONE she met in Perugia. Do you know of any not? By arrest she had not one real friend left. Even Sollecito saw he was toast.

Netflix never mentioned that.

Loud, sharp-elbowed, often rude, often smelly, very lazy, all the other girls in the house saw her as a sex fiend and druggy and wished she’d go away. They had 40 hour weeks, she worked barely ten.

Netflix never mentioned that.

Patrick was feeling that way too; he took her on without a work permit and she was the Employee from Hell.

Netflix never mentioned that.

Mignini knew all this and more and yet he was STILL polite and considerate to her. On 17 December he gave her a terrific chance to get off. No other judge or prosecutor was as kind as that.

Netflix never mentioned that.

He wanted to bring up the dangerous drug-dealer she had in tow and her growing addiction, including to cocaine. Why? So she could maybe argue impairment and seek a manslaughter charge.

Netflix never mentioned that.

Her own lawyers wanted to go with that but Knox’s own parents didnt want it out, and and various judges especially Judge Micheli wanted a harder and no breaks for Knox.

And by end of 2007 Curt Knox’s PR was demonizing Dr Mignini!! 

Mignini and Meredith were the two most understanding friends: in Perugia Knox ever had. She killed one, and has shafted the other ever since.

Netflix never mentioned that.

1. The Context Of The Legal Process

Netflix doesnt make clear that the prosecution presented its full case just the once, in 2009.

The only ones to get the full blast were the jury and others in closed court. The prosecution was compelling and remorseless day after day in a meticulous reconstruction of the case.

The unanimous guilty verdict was predictable and understandable. If you havent yet done so you might want to read how powerful it was. In the US and UK there would have been zero grounds for appeal.

At the “automatic” 2011 Hellmann appeal there was a jury - but essentially no prosecution. How weird is that?! ! All the prosecution got to do was rebut several witnesses for the defense. The jury did not even read the case. Hellmann garbled the DNA (no contamination was proved but he acted as if it was) and so Knox and Guede were sprung.

At the 2013 Nencini re-do of appeal the judge and jury were told at length by the Supreme Court’s First Chambers how to get this task right. Although there was a new prosecutor (Crini) he was very good. The whole case was read by the jury, and the Carabinieri labs were brought in to do a test the “independent” DNA experts in 2011 said could not be done.

Sollecito took off like a rabbit before the verdict and Knox was too scared to appear.

Had the verdict gone to the First Chambers for review,as it should have, Knox and Sollecito would now be inside. Why it went to the Fifth Chambers in 2015 (which never handles murder cases normally) is murky and still under legal dispute.

By this stage the defenses had so many occasions to get things right (over seven years) it was like Groundhog Day. Bongiorno was allowed to rant on about “incompetent cops” for several hours over her legal limit. But the prosecution was not even there. 

2. The Daffy Amanda Knox

Do you know who hit Knox on the head at her so-called “interrogation” 5-6 Nov 2007? She did herself! Nobody else. Day after day straight reporting - not biased or made up, simply straight reporting - suggested that she was odd. Cops think she was maybe on a long bad trip.

Since her arrival in Perugia she had got the backs up of almost everyone she encountered. Many though she was there solely for the drugs and she never even enrolled at the University - merely a language school. She could easily have been funded by the University of Washington but she herself chose not. Maybe because monitoring would have been a part of the deal and drug use would have been out.


They seem clueless as to the power of the case. They never saw the daffy Knox (above) who was wheeled out in 2009-2008 when EVERYONE including her lawyers and seemingly her parents all presumed she had got in over her head.

Apropos of nothing, I was thinking about the famous hair test. Follain, p.143:—

‘Mignini suspected that on the night of the murder Amanda and Raffaele had taken drugs stronger than the marijuana they had admitted to: maybe cocaine, he thought. But no such traces were found in either Amanda or Raffaele’s hair.’

Unfortunately, as neither Mignini nor John Follain seems to have known, the result was meaningless in that context. When Dr Lalli, or the woman doctor assisting him, cut the sample strand of Knox’s hair on 6 November, the previous week’s growth was still below the skin of Knox’s scalp.

The hair test is normally only used to establish whether there is or is not a history of use of the specified drugs (generally cannabis, cocaine, amphetamines, methamphetamines, opiates, PCP and a few others) within the last few months. The various labs that perform the tests according to their own methods all like to claim that their results are ‘absolutely accurate’, but, if you think about it for a moment, there is no likely way they could know that, unless they tested control groups of people who (a) definitely had been using the scheduled illegal drugs and (b) definitely hadn’t. Bit tricky to arrange. In addition, each lab likes to claim that its own patent method is more reliable than those of other labs, so a certain margin of error seems to be a given.

And the drug metabolites are thought to attach to the melanin in hair, so a person with light-coloured hair, such as Knox, is more likely to produce a false negative.

But mainly, as we do not know exactly how close to the scalp Dr Lalli, or the female doctor assisting him, cut the sample strand of Knox’s hair, the result is quite useless for the investigation of Meredith’s murder. Not only did the hair test tell us nothing about the week of the murder, because the potential evidence was still below the skin of Knox’s scalp, but, if the scissors left even a 1cm stump—a month’s worth, as is a quite normal minimum—the test can tell us nothing about Knox’s drug use for the whole of the time she was in Perugia.

This may make it more relevant that she hooked up with mature student and cocaine trafficker Federico Martini on that Milan-Florence train in August, and remained in regular phone contact with Lorenzo, a fellow member of Martini’s subsequently convicted coke syndicate, throughout the period of the murder—her phone records forming evidence in the syndicate’s convictions.

So why would she need the services of Rudy Guede, well known to students in Perugia as someone who wasn’t a dealer, but knew the dealers’ spots and could get you drugs?

Because the whole point of Rudy, and the way he kept in with the student crowd, was that he spared you having to do the run yourself. Even if you happened to know a big-time coke dealer, you didn’t necessarily want to speak to his lowlife street pushers, or even show your face to them. Many students are snobby, and Knox certainly is.

Quick reaction for starters. This looks like Knox 1.0 is back.

That was the 2007-2009 Knox who slipped the leash of her handlers, the one that often ignored both her lawyers and parents, the one who was CONVINCED that given time she could explain everything away and everybody would love her.

Well that did not end well for her at all.

She failed time and again from Mignini (especially on 17 Dec 2007) through Matteini, the Supreme Court, Micheli, and Massei. The one who failed so absolutely on the stand in June 2009 that she was handed a sentence that ended up being three years.

At the Hellman appeal Knox 1.0 was replaced by puppet Knox 2.0 in widow’s weeds.

Seem correct to you? If so this interview is the beginning of the end.

1, Series Overview

The report Amanda Knox first aired globally nearly a year and a half ago. It is still online.

Over 4/5ths of some 300 reviewers of the slanted report, a work by several unindicted felons for Knox PR, concluded that Netflix got it right and Italy got it wrong. Maybe half of the reviews are clearly lathered up.

Since it went online we have acquired a further small mountain of new documents and translations and interviews on the ground. They only go to highlight even further just how many damning facts Netflix chose to leave out.

These several final posts on the reporting get us to where we will challenge Netflix directly via the media to put up or to shut up and withdraw. Coming soon.

ALSO FOR FRAMING

In Netflixhoax 16 we linked to 35 reports by Nick Pisa and challenged anyone to point to even one which confirmed Netflix’s take.

The Netflix report showed British reporter Nick Pisa relishing some early headlines, and a scene where the solving of the crime by the national and Perugia police is announced to the press.

From those seemingly damning episodes, the audience is encouraged to make the vast extrapolation that it was a voracious media and an overzealous police that drove the whole case.

Also that this was fundamentally unfair to a self-effacing, publicity-shy Knox, and that it caused the verdicts to go the “wrong” way - twice, first in the 2009 Massei trial, and second in the 2013-14 Nencini appeal.

First, with regard to the Italian media, it was exactly the other way.

Italian media reported methodically before and during trial and long thereafter on what the US and UK media mostly did not - all the crucial process steps pre-trial were reported in Italy but largely ignored by the UK and US press.

Italians could also (1) see parts of the trial on TV and (2) read all the documents put online.

 

It was about how Netflix maliciously depicted objective reporting from Perugia as fictitious hype.

1. Overview Of This Series

As we’ve been proving, the Netflix report aired globally was highly misleading because it simply left so much out.

For example it left out this. The Italian media was by far the most likely to have an effect on a jury of Italian speakers who are encouraged by the system to do some research. In fact the Italian media reported methodically before and during trial and long thereafter on what the US and UK media mostly did not - all the crucial process steps pre-trial were reported in Italy and there was some televising of the trial. Dozens of court documents were put online and anyone could access them and look. No trial ever in the UK or UK ever has so much openness and transparency.

It left out this. Objective though neccessarily far less detailed reporting for the US and UK was done by carried out by the foreign correspondents group mostly based full-time in Rome.


Netflix left out that.

Inthe 16th post in the Netflixhoax series we listed 35 reports by the British reporter Nick Pisa.

These were some of the many reports on the case that we have quoted from and we asked if anyone could see bias. Pisa’s reporting was for a UK audience and there was almost zero chance it could influence things in Italy.

Netflix maybe omitted this for their own convenience - there was little or no slant to point to at all.

The Netflix team dont appear to have read even one official document on the case.

The key two documents here would be the report on the Massei guilty verdict in 2009 and the report on the Nencini guilty verdict in 2014. That was respectively two years and over seven years after the early “damning” media reports. 

Take a look.

In fact try to find even ONE instance where a UK reporter writing in English for an English audience in late 2007 got inside an entire panel of Italian judges’ heads late in 2009, and again in 2014, which is what Netflix would like you to believe.

2. Good Reporting From Italy

Nick Pisa was made the fall guy when he was flippant about his joy at some headlines. But we have linked to thirty-five of his reports since 2007 and in Post 16 we linked again to each of them and asked if anyone could show that even one distorted the truth in any way. We’re still waiting.

Sollecito Events 2014 POST NEEDED

The 5th Chambers’ judgment, which had Knox at the cottage at the time of the murder, but not necessarily Sollecito, pretty much reflects Francesco’s own thinking. Remember how critical he was of Knox in private. She was the one who had something to do with it and had got his precious boy into trouble. In fact he would not have been that bothered if she had been convicted provided his son was acquitted.

He was going to deliver for his boy come what may, and whatever his involvement, and Bongiorno was to be his instrument.

1. Bongiorno : head of the parliamentary commission for legal reforms and whose most important client had been former Prime Minister Andreotti, charged with links to Cosa Nostra and the mafia murder of a journalist.

2. And where did Della Vedova, with his business links to organized crime, pop up from? Ghirga and Maori were positively provincial, straight-forward guys, by comparison. Vedova was not a criminal lawyer, and it showed as he messed up a bit in court, but with offices in Rome and stateside Washington he was a useful player and conduit for extraneous participants, for both the accused.

3. And where did Hellmann pop up from? Appointed to preside over the first appeal just one month beforehand? With little experience of criminal trials and replacing a judge, who had that experience, and just happened to be the prosecutor, disliked by Bongiiorno, in the Andreotti trials.

4. And where did Conti and Vecchiotti pop up from? Selected by Hellmann of course. And why did C+V hobnob with Francesco and produce such a biased, amateurish and unprofessional report?

5. How did Alessi and Aviello pop up all of a sudden and why did Aviello make, and then retract, allegations of improper inducements offered by Bongiorno for his testimony?

6. Yes, you’re right Pete. Bongiorno became supercharged, almost maniacal, the longer the case went on. Waving a knife around in court, pacing frenetically during recesses, the bizarre press conference with Raffaele (the first real wedge between the defendants positions - had she had the nod that this could work, even for both?), his, her and Francesco’s television appearances, the humungous final appeal recourse with Peter Gills’ misleading contamination hypothesi craftily, and quite unacceptably, included.

7. Rocco was murdered in May 2016. Francesco attended a private memorial service for him just outside Bari. Why would a pillar of the community, a respectable doctor, do that? Either he didn’t think he would be noticed or he didn’t care. If the latter, that’s some chutzpah! Are he and Rocco distant cousins? Rocco was originally from Bari. That’s where Francesco lives and Raffaele was born. I suspect that they share more than a surname and Raffaele’s sojourns in the Dominican Republic was more than a coincidence.

8. And the final, ludicrous, 5th Chambers Motivation, long overdue when it finally came out.

An aspect of the Italian judicial system that needs to be looked at, in my opinion, is the final stage of proceedings.The fact that each case has to be signed off by the Supreme Court places a considerable administrative burden on the system, which is why there are, at the last count, some 396 SC judges. This allows IMO for a measure of under the radar judge shopping, inconsistencies in judgements, rivalries and factions, and judges who are susceptible to improper influence in a country where mafia influence and corruptability stretches even into respectable institutions.

You just have to know how to go about it, and Bongiorno and Vedova tick the boxes.

  Remember that under Italian law he could not run a dishonest or defamatory PR campaign - and anyway, he had little wiggle room: from their reading and TV the average Italian knew THE one set of facts.

  Sollecito’s father is present in the [Porta a Porta] studio. His father talks about the innocence of his son, and only of his son, without mentioning anything in defense of Amanda. “My son was not at that house”¦.  Curatolo could not have seen my son because he was at his house”. He says that if Raffaele was present at the crime scene he would have helped Meredith, and so on.

  The host Bruno Vespa asks Sollecito’s father why did Amanda accuse Patrick, an innocent man? Francesco Sollecito responds “You are giving me a hard task, that of being not only the defender of my son but also of Amanda Knox”.

Building on James Raper’s Point 1 above about Bongiorno’s political powers.

  1. Bongiorno : head of the parliamentary commission for legal reforms and whose most important client had been former Prime Minister Andreotti, charged with links to Cosa Nostra and the mafia murder of a journalist.

She was also the chair of the Justice Committee in Parliament and had a vast say in the annual budgets for national police, prosecutions, courts and prisons.

NO WAY would almost any other country in the world allow that AND taking on a defense role at trial.

When she screamed at Nencini and later at the Fifth Committee about “corruption” they knew she had power over them.

Building on James Raper’s Point 2 above on Della Vedova.

  2. And where did Della Vedova, with his business links to organized crime, pop up from? Ghirga and Maori were positively provincial, straight-forward guys, by comparison. Vedova was not a criminal lawyer, and it showed as he messed up a bit in court, but with offices in Rome and stateside Washington he was a useful player and conduit for extraneous participants, for both the accused.

He always went the extra mile for Knox even when late in the trial we thought any or all of the other defense lawyers could walk, they were all so down.

He keeps very chummy with the American Embassy and may have counseled them that some diplomatic pressure behind the scenes could pay off (as it did).

  3. And where did Hellmann pop up from? Appointed to preside over the first appeal just one month beforehand? With little experience of criminal trials and replacing a judge, who had that experience, and just happened to be the prosecutor, disliked by Bongiiorno, in the Andreotti trials.

Baby-killer Alessi caused Guede to write his damning statement about seeing Sollecito and Knox at the scene.

Waving a knife around in court, pacing frenetically during recesses, the bizarre press conference with Raffaele (the first real wedge between the defendants positions - had she had the nod that this could work, even for both?), his, her and Francesco’s television appearances, the humungous final appeal recourse with Peter Gills’ misleading contamination hypothesi craftily, and quite unacceptably, included.

Building on James Raper’s Point 7 above about the private memorial service for Rocco outside Bari.

  7. Rocco was murdered in May 2016. Francesco attended a private memorial service for him just outside Bari. Why would a pillar of the community, a respectable doctor, do that? Either he didn’t think he would be noticed or he didn’t care. If the latter, that’s some chutzpah! Are he and Rocco distant cousins? Rocco was originally from Bari. That’s where Francesco lives and Raffaele was born. I suspect that they share more than a surname and Raffaele’s sojourns in the Dominican Republic was more than a coincidence.

It was to be a public mass, but the police stepped in and banned it, one of the priests said dead guys are dead guys and lets show them some respect, and so the private service was at 6:00 am.

Reduction of automatic appeals which we have often favored was to be one of ex PM Renzi’s reforms. This cumbersome process goes back to post WWII days and a desire to have the very opposite of kangaroo courts.

One nice thing about the three step process is that the first level of appeal WITH JURY often becomes an answer looking for a problem and meddles with a good trial outcome while hearing almost nothing about the prosecution case.

We had three juries in this case (Massei, Hellman, Nencini) and we saw the notorious yin-yang. We also saw it between the First and Fifth Chambers of the Supreme Court.

Like Groundhog Day Bongiorno got to sharpen her act at every stage and could put on a full opera by the end.

WTF does that mean - “They didn’t take a confession”? Did she offer one?

This whole passage is truly odd. “what was inside me to give them”? Umm, is it so hard to say what you know and what you do not know? “Their methods of interrogating me confused me”? Again, how does asking straightforward questions confuse someone? Lot of implication there without a concrete claim. And then….... the leap to the arrest of Patrick with absolutely no mention of the fact she accused him? Is there nothing in between these sentences?

As for this?

His name “came out” all right. She signed two statements accusing him of murder and then wrote later, in her cell, that it didn’t count—her way of admitting that she lied. She did not once take responsibility for her statements and withdraw them without condition.

You’ve discovered yet more of Knox’s gaping plot holes that allow her to jump freely from inane assertion to inane assertion without her understanding why nobody believes her. Moreover (therefore?) she has learned absolutely nothing in the past six years. She’s still pretending to be a small child depending on some kind of “cute factor” to make her lies acceptable to figures of authority.

Thirty years in prison ought to be sufficient to cure her of that tendency.

2. Rules To Avoid Legal Trouble

Previously we explained the rules-of-thumb for good shadow-writers to avoid legal trouble.

Knox shadow-writer Linda Kulman is NOT the perfect model. The Knox book will soon see Knox back in court defending false claims (like this one) which Kulman should have prevented (and may still be legally liable for). She and Knox included numerous false claims about the evidence and Italian officials which she (and Bob Barnett) would have KNOWN were false if she had pressed hard and looked around. The Italian and UK arms of Harper Collins actually said the book was defamatory and refused to publish, sparking a crash effort on Knox’s book to take out some of the worst bits.

However, Kulman did observe a few of the rules. She brought no psychological baggage or anti-Italian bigotry to her work. She stayed largely invisible in the background. She apparently talked mainly with Knox. She never made any media appearances. And she kept her own name off the book - it appears only once, in a brief credit by Knox in a back section. Book promotion was done by publishing agent Bob Barnett (who seemingly even took Knox to a cocktail party in official Washington) but not by her.

In contrast Andrew Gumbel threw caution to the wind. His reporting record showed clear evidence of a nasty chip on his shoulder about Italy. Both the book and his numerous statements (see below) reek of bigotry for Italians and contempt for Italy and its justice system - part of the embarrassment he has created for the Sollecito family and legal team who hardly mirror the same contempt.

3. Some Historical Context

In posts #1 and #6 we listed various red flags in 2011 and in 2012 which would have have stopped any publishing effort in Italian right at the start. Sollecito and his family and team saw close-up what most of Italy saw: the Hellmann appeal and C&V consultancy being obviously bent, thanks to their own legal help. Cassation confirmed that this was their perception too.

Had Sollecito stayed in Italy during 2012 and 13 as his father wanted him to, the book would not exist. Had he not been trying to get back on good terms with Knox the book would not exist. Had Bongiorno and Maori not wanted to be paid, and looked at the disastrous legal outcomes of previous such books, there would be no book. Had they been frank about the devastating toughness of Dr Gelati’s filed with Cassation early in 2012 there would be no book. Had they checked it out in final draft there would be no book.

Had not Tom Wright and Ann Bremner Michael Heavey paved there way, there would be no book. Had a Frank Sforza desperate for money and recognition not lurched to the dark side, or for the same reasons Moore and Fuscher and Burleigh, there would be no book.

Had Sharlene Martin done due diligence before the book was written (or after it was done but not yet out) there would be no book. Had Louise Burke, Jen Bergstrom, and Tricia Boczkowski of Simon & Schster’s Gallery Books done due diligence before the book was written (or after it was done but not yet out) there would be no book.

Gallery spokeswoman Jennifer Robinson said Sollecito would collaborate on the book with Andrew Gumbel, an award-winning British journalist and author whose books include “Steal This Vote” and the upcoming “Oklahoma City,” about the 1995 bombing.

Costa a lawsuit to Raffaele Sollecito’s book ‘’ Honor Bound ‘’. The deputy public prosecutor of Perugia Giuliano Mignini has sued Sollecito to some statements in the book written by the young along with Andrew Gumbel and published in the United States last September. In the complaint, the magistrate are hypothesized the crimes of libel and defamation. Sollecito, along with his former girlfriend Amanda Knox, were acquitted on appeal from the charge of murdering Meredith Kercher. Mignini was the magistrate who led the police investigation of the crime, and then to support the charge in first and second grade (at the end of March and ‘pending the ruling of the Supreme Court which has used the attorney general of Perugia). The lawsuit was filed to the prosecutor of Perugia but will be immediately transmitted to that of Florence accrual. In volume Sollecito offers his version of the facts related to the murder of Kercher. A complaint of Mignini concerns ia a passage from the book in which he argues that the prosecutor would have had some sort of secret negotiations with the family of the young man. Eventuality already ‘’ categorically denied ‘’ by the prosecution. At the moment neither urge nor his lawyers have declined to comment on the news of the lawsuit.

Cassation re 530 & 628

1. Se il fatto non sussiste [541 2, 542], se l’imputato non lo ha commesso [541 2, 542], se il fatto non costituisce reato o non è previsto dalla legge come reato ovvero se il reato è stato commesso da persona non imputabile [c.p. 85] o non punibile per un’altra ragione, il giudice pronuncia sentenza di assoluzione indicandone la causa nel dispositivo.

2. Il giudice pronuncia sentenza di assoluzione anche quando manca, è insufficiente o è contraddittoria la prova che il fatto sussiste, che l’imputato lo ha commesso, che il fatto costituisce reato o che il reato è stato commesso da persona imputabile (1).

3. Se vi è la prova che il fatto è stato commesso in presenza di una causa di giustificazione o di una causa personale di non punibilità  ovvero vi è dubbio sull’esistenza delle stesse, il giudice pronuncia sentenza di assoluzione a norma del comma 1.

4. Con la sentenza di assoluzione il giudice applica, nei casi previsti dalla legge, le misure di sicurezza

1. Banned for four months from the profession because it accused of aiding and abetting against his client is accused questioned by the prosecutor of Perugia, and implemented by the investigating magistrate who issued the measure, the lawyer Luca Maori and a colleague who had joined him the proceedings.

Charging that the law - known for having defended, among others, Raffaele Sollecito in the trial for the murder of Meredith Kercher (ended with the final acquittal of the young Amanda Knox) “‹”‹- dismissed today during a long interrogation guarantee before the same magistrate. Dark Insights, Doubt and Lessons Learned
Bestselling True Crime writer and South African photojournalist Nick van der Leek writes about the many flashbulb moments experienced writing about the Meredith Kercher Murder Mystery.
Albert Einstein once said, “It’s not that I’m so smart, it’s just that I stay with problems longer.”  One of the tremendously rewarding experiences we [my co-author Lisa Wilson and I] have as authors is our research forces us to set up camp around questions.  We spend time: mornings, afternoons, days, weeks, even months asking questions and pursuing answers.  The amazing thing when it comes to True Crime, especially popular crime, is those answers are out there. One merely needs to go out and make the effort to look for them. And keeping looking.  Seek and we do find!
What makes our narratives distinctive, I think, is that Lisa Wilson and I more often than not work as a team. How many other narratives have two authors, working from opposite sides of the Atlantic?  While Lisa provides a US perspective as a juror and a True Crime buff, I am more interested in the intuitive subtleties that underlie these cases.  The psychology, the economics, the motives. Human behaviour is fascinating, especially when it drives people to the extreme. I’m also intrigued by what these intuitions reveals about us, and society.
I wasn’t always into True Crime, in fact like Ann Rule I sort of fell into it by accident.  While Rule worked with Ted Bundy, I was facebook friends with the model Oscar Pistorius shot dead in his bathroom.  I didn’t intend to write a novel, I simply started asking questions, and then penned a 12 000 word magazine article [intended as a 4 part series].  That narrative eventually became my first bestseller.
Although I studied law and economics, I left the corporate environment to freelance fulltime as a photographer and writer. My great grandfather was a famous South African artist, and my brother and aunt are also both well regarded artists [and yes, freelancers] in their own rights too.  I guess there is something restless in my blood that makes we want to dig beneath the surface, to see expanded perspectives than what the media serves us.  I need to not only explore the world beyond my door, but represent it to myself and others in a constructive and meaningful way. I feel passionate about meaning above all, and it’s gratifying to find so much in so grim a setting where someone has lost their life.  When we honour them, when we remember them honestly, something unexpected happens: we also set ourselves straight, we also get ourselves [and society to some extent] back on track.
In terms of the Amanda Knox case, I stepped into the bullring for the first time in April this year.  I knew virtually nothing about the case other than it had been newsworthy around the world.  I knew “˜something’ had happened in Italy, and that Amanda Knox was somehow involved [or not] because she was a housemate of a murdered British girl [also a student].  Before I started studying the case I had no bias either way ““ I didn’t know whether she was guilty or not.  Based on the little media that came my way, there seemed to me to be equal parts bias that she was innocent and”¦suspicion.
As soon as I started examining the case, literally within a few minutes, my interest was aroused.  It was along the lines of: she’s hiding something.  It was also along the lines that I thought Amanda might be involved in some way, complicit in some way, but probably not involved in the actual murder.  How could she? Why would she?
Again, it is easy to ask these questions and then walk away from them without investing time in their answers. And when they do come they’re”¦well”¦stupefying.
While Lisa travelled to Italy to investigate this case first-hand, I started working behind-the-scenes on a narrative Lisa and I designed a framework for called DOUBT.  The plan was that Lisa would return and then we would work on the narrative together.  I got so caught up in my own research I started on the narrative and by the time Lisa returned from Italy DOUBT was done.  Interestingly, Lisa still wasn’t convinced of Amanda’s guilt when she got back, and we had one or two heated Skype calls while Lisa was still in Italy, where Lisa’s position was set to the default setting of most outsiders to the Amanda Knox case: “but there was no DNA.”
A lie repeated often enough eventually becomes if not the truth, then a kind of truism, doesn’t it? A truism isn’t the truth, it’s a platitude. It’s something you say to get rid of enquiring minds.
No DNA? Well, of course there is ““ at least five instances of it, mixed with Meredith’s blood.  What’s perhaps more bizarre, for example, is the lack of Amanda’s fingerprints in her own home.  A single print? How many of us could say the same about fingerprints in our own homes?  Our computers, door handles, kitchen areas ought to be splattered with prints.  Coming back to DNA, not only is Amanda’s DNA present, but so is Raffaele’s in Meredith’s bloody bedroom.  What is the chance that Raffaele was at the villa, in Meredith’s room, but not Amanda?  What was he doing there if Amanda wasn’t with him? And is it any surprise that Meredith’s bra, cut with a knife after the murder also had Raffaele’s DNA on the bra clasp? This is a guy who had a knife fetish, and who was carrying a knife at the time of his arrest?
In DOUBT [which was banned at first by strident Pro Knoxers and then resurrected as DECEIT] I identified 28 Red Flags.  These were singular signals that seem to show patterns of inconsistency.  Things just didn’t add up.  Indeed Amanda did seem to be [and still is?] hiding something.  In DARK MATTER Lisa and I joined forces. We brought a binocular lazer-like narrative focus to the four days of intense police investigation following the discovery of Kercher’s body at midday November 2nd, 2007.  In DARK MATTER we identified an additional 100 plus Red Flags [we distinguished these from the first 28 by calling them “˜Black Asterisks’].  In addition to these we listed several other Highly Suspicious Events amongst other increasingly odd behaviours ““ not only from Amanda, but Raffaele as well. It is when we pool all of these clues together that a picture begins to emerge.  Patterns emerge.  And suddenly the mystery becomes”¦less mysterious.
If my initial “˜gut feel’ was that Amanda was simply “˜hiding something’, by the end of DECEIT there was little doubt that there was a lot more going on than that.  In fact, I’ve suggested to Lisa that based on forensic evidence alone [if one threw away all the circumstantial evidence], Amanda would still a have a major case to answer to.  Conversely, if one took the entirety of circumstantial evidence, including the on-again-off-again alibi, and simultaneously threw out [ie ignored] the totality of forensic evidence, Amanda would still have a major case to answer to.  That’s my opinion.  Lisa’s too, now that she’s gone beneath the surface of this case herself. The irony is this case is so large, so convoluted, so filled with spin and counterspin, that it is easy to get lost in the details. As we see so often in court cases, it is not a lack of evidence that is a problem, it is the volume of it that gets disconcerting, and frequently confusing.  Confusion and doubt [and “˜reasonable doubt’] go hand in hand.  Of course being confused by a lot of information is not the same as uncertainty based on a lack of evidence, or based on ambiguous evidence. The evidence isn’t ambiguous.
As such it is Lisa’s and my mission to demystify the eight years culminating in Amanda’s and Raffaele’s ultimate acquittal.  Our narratives, especially the first two or three in the series are probably better suited to newbies [people like us].  In THE IVORIAN, and the many narratives to come after that, Lisa and I expect to be as well versed as some folks on forums and resources like the incredibly valuable True Justice.org.
Before wrapping up, I’d like to share a final insight based on our experience writing another true crime series.  It may seem like Amanda Knox, Jodi Arias and Oscar Pistorius are three distinct individuals, with nothing in common.  But when we look closer we don’t simply see matches in certain defense schemes, we see entire patterns of conduct [including motive] overlapping, and doing so perfectly.
In South Africa we have a similar situation where the media profit out of stories on Oscar Pistorius.  They are reluctant to declare him guilty as that would be slaying a potential “˜cash cow’, and with book deals hanging in the balance [an acquittal is literally worth millions], the media are hedging their bets.  As a person involved in the media I am appalled at this, hence our eight narratives on Oscar, two detailing his motive and the method of what we speculate was premeditated murder.  In terms of Amanda Knox, we suspect a similar game play between the media and Knox.  Both seem to be involved in a kind of PR waltz which both stand to benefit from, if they can dance consistently to their own music .
It was once said of Lance Armstrong that one shouldn’t make Lance Armstrong angry.  Anger is what motivates Lance to win.  And then the punch line: “˜Beating Lance makes him angry.’  Lisa and I have been astonished at the level of organisation and aggressive militancy [and dirty tricks] employed by Amanda’s supporters.  If this was intended to dissuade us from writing, these folks couldn’t be more wrong.  We are not out to make money, Lisa and I, although we care that our narratives resonate and are successful.  What we really care about is justice.  The bottom line, whether one is a criminal, or the supporter of a criminal is you never look good trying to make someone else look bad. The venom and personal insults Lisa and I have endured in our reviews is impressive.  The strategy is clear ““ attack the credibility of the messenger [since the message itself is problematic].
Our credibility is simple to establish. For my part, I am a professional writer. I did not gain a twitter following of almost 14 000 based on bad writing.  I write in partnership with Lisa because her research is often deeper and even more thorough than mine.  For me our credibility is based on just two tests:  our personal standards and our level of honesty towards ourselves and others.  What distinguishes our narratives from all the others out there is the level of honesty ““ including self disclosure ““ both of us bring to our work. This is because we care about something beyond justice. Besides wanting our readers to have a meaningful and genuine experience reading about these tragic crimes, we ““ as authors ““ also want to be enriched.  When we make it a personal journey, the insights and intuitions are truly rewarding. We find how these folks ““ not only the victim but also the perpetrators ““ are not so very different from us.  In this sense, if when we genuinely learn something from these true stories, Meredith Kercher’s death need not be in vain.

It does seem to me to be quite important: I’m not suggesting that Nencini was straining at the leash to incarcerate the only perp available to him, but surely he must have been concerned that any penalty (even up to immediate custodial arrest) which he could have inflicted on The Italian would be perceived as manifestly unfair. Not least in Italy. Thus a passport withdrawal was a sensible option - and Nencini hinted (IMO) that if he had jurisdiction over a US citizen he’d have sought the same restriction on her global movements.

I don’t think any of this is lost on the Sollecito family, but I do agree that following the final cassation ruling the situation is going to change absolutely. Assuming the convictions are upheld, there is no alternative to immediately taking Sollecito into custody, to serve the remainder of his 25 year sentence.

But it isn’t going to be only the Sollecitos who will (justly IMO) become extremely agitated if there is any laxity in incarcerating Knox - in gaol in the US in the first instance, if extradition is delayed by one single day - it will be the whole of Italy (and, I’d venture to suggest the whole of Europe).

This time around, it has been referred to the Fifth Criminal Chamber of the Supreme Court for a ruling in the case of Amanda Knox.

The twist though is this time around, Sollecito has asked for his case to be heard by a different court, Le Sezione Uniti, the Unified Court which deals with conflicting rulings and may direct his case to a different court to resolve those differences. If it agrees with Bongiorno and Luca Maori’s request then there may be delays. That’s why we haven’t heard about his appeal yet. We shall see how that goes.

Which is good news indeed, that #RaffaeleSollecito’s request to be heard before United Sections (Sezioni Unite) which is composed of a full nine judge panel has not been allowed, but will be heard alongside #AmandaKnox with a 5 judge panel.

Sollecito:

Request: that the sentence be annulled.

Reasons for appeal: 1. Uncertainty of Scientific Evidence 2. Accusatory declarations of Rudy Guede against Sollecito should not be deemed usable/allowed 3. Reasonable Doubt 4. Witness Reliability.

“The trials lacked an adequate review of the “individual” role of Sollecito, generating instead a sense of his guilt due to the “power of attraction” to Amanda and because of her a “confession” made by her, which never mentioned him at the scene of the crime. 1a) That declaration should be used as a favourable element showing Sollecito was not at the scene of the crime, not as a piece of evidence that confirms his guilt. 1b) the DNA on the bra clasp is not reliable 3c) Request that findings by Vecchiotti and Conti be considered valid, including arguments that show an unreliability of the affirmations of forensic Police Biologist Patrizia Stefanoni, and specifically that the appeals court “illogically excluded the possibility of contamination of the bra clasp (p.317)

The appeal focuses heavily on the role of Rudy Guede, and which of his statements and depositions should have been legally allowed as evidence against Sollecito. Sollecito’s lawyers also make the argument that since a number of Guede’s statements were used against him, his lawyers should have had the right to a proper cross examination of Guede (in this part of the appeal, p 298, the three other European cases are cited: Kostecki v. Poland and Al-Khawaka and Tahery vs. UK and Yevgeniy Ivanov v. Russia)

However there is also the argument that Knox and Sollecito’s positions should have been separated. As an example, on page 64, cites Giulia Bongiorno’s reading of Knox’s statements to police, noting that Knox repeatedly says “I.” The appeal argues that Knox’s declaration to police at 1:45 a.m. should be usable by the Sollecito defense as an element of proof that he was not present. Specifically, there is attention drawn to the subject-verb agreement and the fact that Knox repeatedly speaks in the singular form: “I see Patrick” and “I heard Meredith scream.”

“Not even in the most dramatic phrase of the night between November 5 and 6 did Knox ever maintain that Sollecito was perhaps with her in Via della Pergola.” (p74-76)

That these statements could not be used as a defensive element by Sollecito is “the first and most relevant error committed by the court.” (p75)

The appeal also argues that Knox furnished Sollecito with an alibi when she said she left the house, telling her boyfriend she had to go to work, leaving Sollecito alone at home. And even if the court were to believe the strategy that Knox “exchanged one black man for another,” by blaming Lumumba when it was Guede at the scene, that still excludes Sollecito from responsibility. (p.76)

In conclusion, the appeal also notes that the range of the aggression against Kercher was between 21-22 and that Sollecito’s Macbook Pro shows that at 21:26 a multimedia cartoon “Naruto” was opened,which lasted 20 minutes, shows it was impossible that he was involved in the crime.


Knox:

Request: Ricorso for 1) questions of constitutional legitimacy and 2) 11 reasons related to contradictions, illogic and deficiencies

Laws/reasons cited: Violation of Art. 606, B, E for contradictions, deficiencies and illogic in the reasoning, specifically:

1. lack of a motive.

2. merits of forensic science.

3. relation of the slander conviction with the homicide conviction.

4. mode of entrance into Via della Pergola and the footprint evidence.

5. Alibi and witness testimony of Curatolo and Quintavalle

6. Violation of observance of laws with regard to Art. 606, C with regard to documentation that had been declared not allowable for use in court.

7. Violation of observance of laws with regard to Art. 606, C with regard to allowing the sentence of Rudy Guede to be considered as evidence without the possibility of thorough cross examination.

8. Violation of Art. 606. with relation to Constitutional Art. 111, 2 and 238, for not allowing thorough cross examination of Rudy Guede, after he affirmed accusations against Knox and Sollecito in the first appeal.

9. Violation of 606, B, E, for using inexistent evidence (this refers to Nencini material error on page 321 when he discusses DNA of Sollecito found on the knife “” Sollecito’s DNA was never found on the knife).

10. Violation of 606, E, B, with regard to ordinances that regulate court debate/ arguments, with specific reference to Sept. 30 (question of constitutionality) and April 17 (a clerical/material error stating Amanda Knox was born in Seattle, not in Washington).

11. Violation of 606, B: with regard to the sentence, since the slander charge is contested.

“This defense asks that the court rectify a grave judicial error, which includes the court of appeals, so as to permit the defendant Amanda Knox to re-initiate a normal and constructive life. “ pg. 115

ROME - The Fifth Criminal Chamber of the Supreme Court headed by Gennaro Marasca acquitted Amanda Knox and Raffaele Sollecito, defendants in the trial for the murder of British student Meredith Kercher. Only the Knox was sentenced to three years for the crime of slander, sentence served.

Knox speaks. From Seattle Amanda Knox declares “Tremendously relieved and grateful” for the ruling of the Supreme Court, in a statement sent to US media. Knox pointed out that only his awareness of being innocent gave her “strength in the darkest moments of this ordeal” and thanked family, friends and even strangers for support had in years. “To them I say: Thank you from the bottom of my heart,” says Amanda. The family of the young Seattle issued a statement in which it expressed “deep gratitude” to all those who supported it. Statement later reiterated to the media present outside his home: “I am very grateful that justice has been done. Thanks. I’m grateful to have my life,” he said coming out of the garden with his mother, sister and boyfriend. “Meredith was my friend. He deserved a lot in life. I am that lucky,” he added.

“Finally it’s over”, said Vanessa Sollecito, sister of Raffaele, after the acquittal. “It ‘s over ... it’s over ...”: Francesco Sollecito, the boy’s father, welcomed the judgment in tears. “We are crying for joy” is only able to add. Francesco Sollecito waited with his son the judgment. The man took the news of absolution from daughter phoned him at their home in Puglia. In the background in the home feel cries and screams of joy. “Meredith is the first and biggest victim of all this tragedy because it is she who lost his life and we have always been close to his family. She did not even attend high school at the same time as Knox’s father - she is 59 years old FFS.

The publisher announced Thursday that “Presumed Guilty: My Journey to Hell and Back with Amanda Knox” would cover his relationship with the American exchange student, their arrests and imprisonment in Italy over the death of Knox’s roommate, and their eventual release last fall after the convictions were overturned.

Financial terms weren’t disclosed. Last month, Knox agreed to terms with HarperCollins on a deal worth $4 million. While numerous publishers bid on the Knox book, the deal for Sollecito’s memoir was reached after Gallery made a “pre-emptive” offer to literary agent Sharlene Martin.

Gallery spokeswoman Jennifer Robinson said Sollecito would collaborate on the book with Andrew Gumbel, an award-winning British journalist and author whose books include “Steal This Vote” and the upcoming “Oklahoma City,” about the 1995 bombing.

Costa a lawsuit to Raffaele Sollecito’s book ‘’ Honor Bound ‘’. The deputy public prosecutor of Perugia Giuliano Mignini has sued Sollecito to some statements in the book written by the young along with Andrew Gumbel and published in the United States last September. In the complaint, the magistrate are hypothesized the crimes of libel and defamation. Sollecito, along with his former girlfriend Amanda Knox, were acquitted on appeal from the charge of murdering Meredith Kercher. Mignini was the magistrate who led the police investigation of the crime, and then to support the charge in first and second grade (at the end of March and ‘pending the ruling of the Supreme Court which has used the attorney general of Perugia). The lawsuit was filed to the prosecutor of Perugia but will be immediately transmitted to that of Florence accrual. In volume Sollecito offers his version of the facts related to the murder of Kercher. A complaint of Mignini concerns ia a passage from the book in which he argues that the prosecutor would have had some sort of secret negotiations with the family of the young man. Eventuality already ‘’ categorically denied ‘’ by the prosecution. At the moment neither urge nor his lawyers have declined to comment on the news of the lawsuit.
