The Nencini Report Complains About Multiple Instances Of Evidence Tampering And Criminal Slander

Posted by Our Main Posters

[Edda Mellas, Curt Knox and Chris Mellas might be among those knee-deep in the soup]

Already investigations were under way into a PR campaign that in Italian juidicial terms seems little difference from a criminal enterprise.

Now Judge Nencini has included strong complaints in his sentencing report about nefarious behavior. This might now set a number of people to wondering if they have painted felony targets on their own backs, though the seriously dopey ones may have to have it spelled out for them.

This summary of the complaints is from Andrea Vogt’s excellent report in The Week/First Post which also highlights the appeal findings.

1. Interference with the courts

...during the course of Knox’s long and drawn out judicial process, Judge Alessandro Nencini claims, serious attempts were made to tamper with evidence in a way that would favour her….

In the scathing report that spells out the evidence, logic and reasoning that led to his guilty verdict in Florence on 30 January, Judge Nencini also says Knox and her defence tried to tamper with evidence and pervert the truth by introducing prisoners as witnesses, whose testimony turned out to be false and induced by “other interests”.

“It is clear how this trial was subject to heavy evidence tampering, both internally (slander) and externally,” Nencini writes.

He calls the media interest in the case “fertile ground” that led a number of witnesses to give misleading testimony in exchange for their moment in the limelight.

He also slams the first appeal court’s independent experts for having been oddly superficial and illogical in their analysis of the DNA evidence, especially regarding the potential for contamination, noting that controls were in place to prevent it….

2. Vilification campaign post 2011

Knox and Sollecito were released from prison in 2011 after an appeals court sensationally acquitted them of nearly all charges (one charge against Knox stuck: the slander of Congolese pub owner Patrick Lumumba, who she initially blamed for the crime).

The acquittal ruling, however, was later annulled by Italy’s Supreme Court and a second appeal trial in a jurisdiction outside Perugia was ordered. By that time Knox was safe and sound back in Seattle and chose not to return to Italy for her Florence appeal, instead emailing a statement to the judge, proclaiming her innocence. Sollecito attended.

On 30 January, Judge Nencini and a lay panel of jurors issued a guilty verdict and handed down an even harsher sentence: 25 years for him and 28.5 years for her.

Knox went on national television back in the US the following day claiming, as she always has, that she continues to be the victim of a gross miscarriage of justice carried forward by inertia by dozens of Italian judges.

But in his report, Nencini suggests the gross miscarriage was by Knox and her defence lawyers: indeed, he gave her a longer jail sentence precisely because of the gravity of the slander against Patrick Lumumba aimed at getting investigators off her back.

A small group of fervent supporters continue to lobby on Knox’s behalf and earlier this month she attended an Innocence Project conference with other exonerees, even though Italy’s courts have upheld her convictions….

With this latest development… there appears little wriggle- room for either Knox or Sollecito. Italy’s Supreme Court is expected to give the final ruling on the case after September.

This post was about Amanda Knox’s seriously surreal appearance at that conference of the Innocence Project.

We will soon post a helpful roadmap to all the other numerous suggestions of nefarious behavior on which we have posted. We dont mean to isolate out just Edda Mellas, Curt Knox and Chris Mellas.

Amanda Knox with her highly defamatory website and new charges pending for her book is one of the worst offenders.

Comments

See what happened here? Giulia Bongiorno among many others (obviously including Olympic-class tonguewagger Amanda Knox) has backed herself into a corner.

This is how the Italian system protects itself. A fascinating process. It gives bribers and grandstanders and perjurers enough rope. Then they helpfully hang themselves.

Giulia Bongiorno has played dirty tricks by the dozen. She wheeled out the jailbirds who Nencini highlights, Alessi and Aviello. Both now face perjury charges - and the fellow inmates of one said bribes were floated for testimony favorable to Sollecito.

Then Bongiorno went way too far and cooked up a charge against Judge Nencini which the other day the Council of Magistrates threw out. And now he has placed a target on her own back.

Interesting to see the three photos above.  Oddly enough, my first thoughts on reading the first articles on Nencini’s report this afternoon (here), were, ’ I wonder what Curt Knox and Edda are thinking and feeling today?’

I just saw the poor amanda knox write up by some paper which says nothing.

So I just wrote the First Lady and spoke to her as the mother of mixed-race children and as an African American (black) herself-to please intervene and stop the ethnocentrism and racism being perpetuated in this situation. I only wrote the First Lady once before and she personally wrote back!!

I don’t trust our government to do anything about this, but the First Lady, she just might!

Hi Friendofstfrank

This coulod certainly work. That Judge Nencini actually referred to the Innocence Project conference which was in Portland Oergon just a couple of weekends ago shows that not only Knox & co but the American media are under close observation from Italy.

There has already been a noticeable backing-off from any support for Knox by anyone with influence who does their homework. Official Washington for sure.

And Italian American politicians and organizations are expected to push back now that this rejection of the illegal excesses of the campaign has become official.

In light of what is described in the post at the top the TV talkshows might drop the case like a hot potato or strive more strongly for balance. I’ve had requests for talking points.

Stay tuned. This looks like the big reversal.

I hope so, Peter, and I also hope the ethnocentric racists in the U.S. who propagated all the misinformation and slander are held to account.

I am keeping my fingers crossed for the First Lady to say something-she is above and beyond the politics that our elected leaders are subject to.

Hello Peter and all,

Thank you for your diligence and continuing informative posts.

It truly is fascinating, and I do hope finally it is “the big reversal.”

“That Judge Nencini actually referred to the Innocence Poreject conference which was in Portland Oergon just a couple of weekends ago shows that not only Knox & co but the American media are under close observation from Italy.”

Did he?? Wow, that’s interesting. The audacity of Knox to go to that, to stand on the stage with all the other exonerees as if she belongs there is just mind-boggling. Made me sick!!

All three convicts are terrible people, but at least Guede is doing his time with his head down, seems (somewhat) remorseful and is trying to better himself, at least

Raffaele bothered to have the respect show up to his own trial and conducts himself in a generally slightly more respectful way.

Knox’s impudence is really staggering - she actually thought she could get away, not only with murdering Meredith and slandering her innocent boss, but making up lie after lie in her ‘book’ and not having to face the consequences!

She really does live in her own dream world. Not for long though…

Thanks so much for all the updates and the fascinating posts over the past two weeks… any ideas on when the first translated version of the Nencini report may be available?

😊

Big news, eh? Thanks for scooping the word Peter Quennell! Thanks to everybody who cared.

I read Amanda’s statement which was full of lies…no surprise there. She said she claimed her innocence from the beginning, but I did not hear her say it until the Hellman verdict. She also said there was no evidence against her..

I would like to see her criminal enterprise and everybody involved, to get their rewards..in full.

Today, I am satisfied….onward.

RIP Meredith Kercher

I had never seen this ‘screenplay’ clip before today - very strange!  Or just fits.  The ego.  The distance from reality or at least emotion.  The elements of the crime embedded in a fantasy story.  I guess she wrote this while still in prison as the actors are Italian?  It’s quite disturbing.

http://truejustice.org/ee/index.php?/tjmk/comments/the_hands_of_time_video_with_screenplay_by_amanda_knox_-_a_confessiona/

The portrayal of the crime as written by the Nencini report are horrifying but logical.  What do they mean about the circumstantial evidence locked up?  There must be something else we don’t know about.  Their clothing?  Other DNA or blood evidence?

I’m wondering if Robin Roberts and others at ABC are changing their opinions yet, or feeling kind of like fools. Doubtful.

No wonder RS won’t say anything - if he’s too tied up in the violence of the crime.

Thank you Peter for keeping us up to date.

I am pleasantly surprised that Judge Nencini remembered and noted the interferences from the defence teams and their clients.

Last time I checked, Amanda Knox supporters blamed the prosecution team for witnesses Aviello and Alessi, when in fact these were defence witnesses who contradicted each other.

I hope this case will now soon come to an end so the Kerchers can get some closure and hopefully some peace. They are unjustly being vilified by Amanda Knox and her supporters. She should be ashamed to encourage her followers to attack them.

News from Seattle:

“The recent Motivation document does not – and cannot – change the fact that the forensic evidence still does not support my participation and the circumstantial evidence still remains unreliable and contrary to the conclusion of guilt.”

When is she going to realize that just repeating a mantra “there is no evidence against me” couldn’t help her any more?

dear Seeking Understanding,

IMHO Knox and Mellas are figuring out how sweet little Amanda is going to avoid extradition. The list that overlaps both the US and Italy is grim- mostly African countries (not South Africa) or the Middle East. Oddly enough the Vatican, but my bet would be the UAE, or North Africa. Amanda has no intention of doing time is my guess.

I am confident the US will gladly give Foxy the boot. I am grateful someone had the balls to call out the facts without PR BS.  Thank you Judge Nencini for walking the road of justice for Meredith. I am skipping along, well, without my cloak of course!

Well Now! I was all over the news programs and was pleasantly surprised at how little there was concerning Knox anyway.

CNN, Fox etc. reported a big fat zero. On the other hand with CNN.com there was about two hundred or so posts which rapidly degenerated into Italy bashing and how Americans were treated badly in every other country. Perhaps those who decried this observation should ask themselves why?

Of course it has been known for many years that Americans traveling abroad to anywhere are advised not to advertise the fact. I’m not suggesting to holiday places such as the Caribbean or some such, it’s just generally excepted that self advertising for US citizens is not wise and will result in bad waiter/hotel service at the very least particularly in France. This is a holdover from the generation of the fifties of course and is thankfully with the global dilution of ethnicity and identity of country diminishing.

Of course the view of Americans is that the US itself is sacrosanct as envisaged by all the US flags particularly in towns with an older population. The Southern US is still fighting the civil war so they promote their own version anyway.

However as far as Knox is concerned the vast silence from the majority of the US populous indicates, at least to me, that this is old news and people just don’t care that much what happens to Knox anyway.

I see far more news being generated if Italy goes after Knox family ‘Larry Curly and Moe’ That’s coming up and if there is a brouhaha over that it also wont make a scrap of difference.
Bruce Fischer plus the Moore’s and Heavey of course, are oddly silent. However I fully expect a squawk from that direction. In the meantime ‘Bravo Zulu’ to Nencici and all the others who contributed to this verdict.

Hi Grahame,

Just to add a bit to your post, I watched Good Morning America, and their legal expert Dan Abrams (what a joke) and he still says that the U.S.will not extradite Knox. He and ABC are still blindly carrying on with this, why cant they admit they have been taken for a ride by the Knox P.R.

You mention Fischer, the Moores, and Heavey, but its time for the likes of Abrams, Vargas, Van Sant, Velez-Mitchell, and Pinskey to be handed their asses and shown the door. They have done a huge amount of damage by misinforming the American public.

Barbie Nadeau says in The Daily Beast, “Nencini ruled that there was plenty of forensic evidence tying Knox and Sollecito to the crime scene.”

“They left their tracks in the victim’s blood,” Barbie quotes from the motivations report.

This quote is written in large white letters inside a black box standing at the left of Daily Beast article.

“THEY LEFT THEIR TRACKS IN THE VICTIM’S BLOOD”—Judge Nencini.

Yes, Professor Snape.  Cloak or no, I am with you on the skipping track!

Good on you, Judge Nencini, for a report that sets out the bare truth and does not pull any punches.

I look forward to the English translation once our poor, hard-working translators finish it (if, indeed, they are planning to translate - it is a huge undertaking especially when the team is international and based all over the world).

I also look forward to the day - coming soon - that Sollecito is arrested and taken to prison.  I do wonder if he will begin to squawk.

You never know but of course that will mean his admitting his part in the crime.  Difficult choice after all these years of shenanigans.

AND Greta believes in him entirely, I gather.

Well, she can access Nencini’s report straight away.  I wonder if she will and if, after reading it, she will still believe 100% in Sollecito?

Posted by thundering on 05/01/14 at 06:46 AM | #

P.S. I would be pleasantly surprised if Italy went after the family.

I think they will work at getting Knox back as a priority and then ....?

Good if they do but after all these years of postponing Curt and Edda’s slander trial, I wonder if they will.

Or perhaps they are saving up all the crimes in order to have whopping big charges to ensure a catch?

My, this case could still go on for years yet!

Reading the extradition treaty again, one comes across the following: http://internationalextraditionblog.files.wordpress.com/2011/03/italy.pdf

“Article 18 provides for the seizure and surrender to the requesting State of all property related to the offense for which extradition is requested. This obligation is subject to the rights of third parties.”

I would not be surprised if Italy does not go after Amanda Knox’s assets.

Posted by Ergon on 05/01/14 at 02:48 PM | #

Peter, thanks for link to comic relief of Steve Moore’s “daft rant”. Funny he should pick for an illustration a painting (The Last Supper) that was done for Ludovico Sforza, the Duke of Milan. Sforza, as in Frank Sforza whom Moore is sounding more like every day.

Also funny how Steve shows the Christ figure blacked out. It’s his symbol of Knox wiping out her DNA presumably to show the impossibility of her doing so. So Moore puts Jesus in black, while standing a few inches to the right is Moore’s photo of himself leaning on a stone bridge with cigar wearing black.

Coincidence? doubt it, he equates himself with blacked out man of importance like Christ in “The Last Supper” because now he’s seriously worried about the fallout from his wrongheaded stance. He’s facing FOA disciple betrayal leading to his demise.

He has always thought himself the wise one like Christ surrounded by FOA idiots depending on him and learning from him, Mr. FBI. He supported their equivalent of Dan Brown’s DaVinci code nonsense when it came to the truth about Knox.

His blacked out figure says he’d now prefer to be “out of the picture” after Nencini rules Knox guilty. World opinion shifts, and now he is the one who may now have to suffer for his FOA crowd. He wants out before the crucifixion.

Well, that’s how I read his inclusion of The Last Supper over his wacko article.  gmancasefile

My husband and I once painted The Last Supper after we first married as a project together. One like it had hung for decades in the classroom of my childhood church. We used a paint by number kit (ha ha, now I’m the comic relief, ours was no masterpiece). That’s why Steve’s illustration jumped out.

The link to Andrea Vogt was enjoyable, especially the comments.

Nothing funny in this:

“This unprincipled decision has shaken, and will continue to shake to the core the world’s belief in the justice of Italy’s legal system.  And we saw it coming. You know, maybe the court in L’Aquila got it right after all. Maybe earthquakes are predictable.”

Andrew Gumbel, Raffaele Sollecito’s co-writer on Honor Bound has written an attack on the Nencini Report for The Guardian. http://www.theguardian.com/commentisfree/2014/may/01/amanda-knox-retrial-new-report-italian-court?commentpage=1

My response here:

“This is addressed to Andrew Gumbel and The Guardian exclusively.

Andrew Gumbel (and the Guardian) needs in the interest of full disclosure to let readers know he co-wrote Honor Bound co-accused Raffaele Sollecito’s now disproven alibi, er, book. He might therefore be somewhat biased in his interpretation of the Nencini verdict.

I am one of the administrators of Perugia Murder File, and an editor at The Murder Of Meredith Kercher Wiki, sites dedicated to exploring this case, and fairly reporting all the evidence to the English speaking public.

We understand the Guardian is well within its rights to support Amanda Knox and Raffaele Sollecito. But, as over a hundred writers felt compelled to sign a letter calling out the paper for bias and incorrect reporting, should you not strive to achieve some sort of balance by allowing the other side to present the case for guilt?

Looking forward to a response from the Editor.”

Posted by Ergon on 05/01/14 at 04:40 PM | #

yes, Helder, quite so.
‘Unprincipled’ is the total opposite - the report emerges from a highly principled position - a responsible and considered endeavour for justice.

It is unprincipled to use the word unprincipled.

Another letter to the Guardian:

http://discussion.theguardian.com/comment-permalink/35076175

“Andrew Gumbel has made several serious errors of reporting:

By saying “convicted again” he misrepresents the steps of the guaranteed appeal process in Italy. First, the intermediate appeals court confirmed the original conviction by Judge Massei. Second, there are only two verdicts so far, not three, as the Hellmann acquittal was annulled. The final stage will be decided at the Supreme Court.

Judge Nencini took the whole weight of evidence of a clean up, including partial footprint blobs and lack of fingerprints, as evidence of clean up. Gumbel clearly has not read the entire report, but relies on the defense talking points to refer only to the DNA analysis.

Granted there is a typo on page 321, the mixed DNA trace might refer to the bra clasp and not the murder weapon. Or, there were two DNA profiles on the knife, Knox and Meredith’s. Gumbel ought to know that judge Massei’s report also had typos and slight errors, rectified by the time it went to appeal, and is not in itself reason to vacate the decision, or, as he seems to hope, give the Supreme Court an out to vacate the decision.

He also faults the judge for coming up with a different motive. He ought to know that judges are not bound by lower court reasoning, and could come up with a different motive. He surely accepted Judge Helmann’s different reasoning, but cannot accept Nencini’s? As long as it is logically argued, the Supreme Court will likely accept it. But perhaps he has blinders on?

Gumbel seems to think the case has been drawn out, and therefore ‘suspect in the eyes of world opinion’. It is only 6 years since Meredith Kercher was murdered. Italy’s system, acknowledge as being defendant friendly, has given Ms Knox and Mr. Sollecito three chances to argue their innocence. Not all defendants in the UK or US are give the same right. And if they were, it might also take them at least 6-7 years to get a finalized verdict.

Why is Italy being held to a different standard? Amanda Knox and Raffaele Sollecito?”

My first letter can be found here, FOA there already 😊

@Ergon, great job to confront The Guardian with its biased reporting a la Gumbel. Such letters are a significant effort in defending the truth.
I hope The Guardian is honest and brave enough to respond, and to allow other viewpoints for balance.

Less funny than his choice of art is Steve Moore’s candid attack on the Nencini court as “corrupt”. He pulls no punches in excoriating the decision against Knox as judicial corruption. Bold words and total falsehood by Mr. Moore. Wow! He is on thin ice to say the least.

Posted by Hopeful on 05/01/14 at 07:30 PM | #

When I was just a young sprout in England we had this saying “Liars In England Survive” as in LIES.

The point is that in England everybody lied to each other all the time and this was excepted since everybody knew it. Therefore if you wanted to find out the truth better check it for yourself.

Enter that international man of mystery Steve Moore famous crime fighter who, while hiding in his secret lair somewhere in his house, takes the trouble to write “Garbage” (As in G Man Moore) in the hope that nobody will check it to closely and thereby prove him defective.
Now of course it’s not his fault that he looks like a cross between Elmer Fudd but Yosemite Sam but it is his fault for being stupid by lying to himself and others. After all he gives the FBI a bad name.

It is unfortunate that his desperation in this shows so much that he will write nonsense in the hope of remaining relevant to the FOA crowd, after all that’s all he’s got.

For example on his web page he states that there was no DNA in the room at all (Except for Guede’s of course) and that the entire thing is some Machiavellian scheme by the entire Italian Justice system. He sees that the Italian court is some vast Wili Coyote cartoon who sit in smoke filled rooms laughing hysterically thinking up ways to stick it to Amanda Knox. OK FBI guy here’s the thing.

(1) Meredith Kercher is murdered
(2) The local police arrive to find Knox and Sollecito at the house.
(3) The police break down the door to the bedroom and Knox makes the statement about knowing the position of the body even though she cannot see into the room.
(4) There has been a break in but Sollecito says that nothing has been stolen even though he does not know this.

FINE…

(5) Sollecito goes to the police station to make a statement with Knox The police don’t want to bother with Knox, so she is told she can wait in the waiting room.
(6) Sollecito does not back up Knox claim that they were at his place all night.
(7) Knox folds and says it was Patrick Lumumba and she was there when Meredith screamed.

In Steve Moores blog in the first paragraph he states that
“The appellate court had the same evidence in front of them as did the court which exonerated them.”

This is a lie.

Moore contradicts himself in the next sentence by saying that in addition there were,

“Several pieces of evidence that even further proved the innocence of Knox and Sollecito.”

Not only is this a lie but it’s stupid, you can’t have it both ways.

He tries to cover his ass by adding that (Apparently at the behest of the court of Cessation) indicating that in his twisted view the appellate court was “GOT AT”

It goes on. In the next paragraph Moore attempts to explain why the guilty verdict came down. He does not say who said what or why he just makes another stupid statement at the end to the effect that

“The court of Alessandro Nancini is guilty of Judicial Corruption.”

Way to go Steve dig the hole your in a little deeper

He goes on that there was no DNA. There was no motive. There was reason whoever because who ever had cleaned up had done so without moving anything.

So tell me Steve why the clean up?

Of course there are some that believe what he writes but then only in the USA are there people like Jim Jones, David Koresh, Warren Jeffs etc;

If the greatest group criminal experts sat down with Steve Moore for ten years eight hours a day and explained to him why Knox and Sollecito are guilty of the murder of Meredith Kercher then at the end of those ten years Steve Moore would still be an idiot convinced of the innocence of these two.

Face it, read his web page for yourself. The man is obviously unwell and living in an action movie of his own mind. He should seek professional help and remove his famous cloak of invisibility and/or catch the joker. Better yet Steve why not write a screen play you may have more success with that.

Often responses to tips happen behind the scenes here and not out in the open where Moore and others with a terrorist mentality can read them.

It is very important to include links so we can click through to what is being talked about. For others: this was Helders comment.

The more I read this motivation, the more obvious it seems that Nencini is handing the defense a golden opportunity to appeal and signaling a red alert to the ECHR that exposes the multitude of violations. There just isn’t any sound reasoning for this. If he has been practicing law as long as I think he has, there is no way he believes this absurd & absolutely ridiculous theory, motive or anything that is included in this 300+ page report.

The case was declared closed 5 days after the murder before any objective review of the physical evidence. A theory was determined by a rather creative prosecutor. Evidence gathering, evidence anslysis, and the interrogations sppear to be designed to fit the theory. Declaring Amanda the one to deliver the fatal slash despite lack of credible evidence does seem to fit some delusional witch hunt. In fact in spite of no violent background she seems to have suddenly become a Charles Manson with the power to make grown men kill at her whim. This is an extremely disturbing and tragic case of injustice.

Steve you have hit the nail on the head beautifully with your penetrating analysis. I, foolishly am reading this report from the beginning, but even by page 40 it is absolutely evident that what we have here is a tyrannical system exploited by a cabal of self-selected well paid opinionated people, who make Kafka’s judges and prosecutors look tame. In this ‘nonsencini’ document I have so far not once found a mention of the word ‘justice’. It is all about justification. About tricks of the trade to justify a criminal investigation that was obviously rigged as a smokescreen to cover criminal activities by people paid to fight against, not for, crime. This report encapsulates and extrapolates ad absurdam all of the basic faults you could work into a legal system that is answerable to nothing but itself. And it underlines the miracle of the Court of Appeal of Hellmann and Zanetti that released these two innocent people, who had been trapped in a massive prosecutorial spider’s web. It is high time for what is left of the civilised world to cry out against a judicial tyranny carried out by a well-paid unconscionable cabal who cover their scruffy lies with pomp and verbosity, just as in Court they cover their scruffy jeans with tasseled robes.

An excellent article that hits at the truth regarding Justice in Italy today and for some years before . I have been shocked in the past by a case where clearly the conviction was not based on Beyond Reasonable Doubt . I’m certain the author will not be the only person to see the discrepancies .

Great article Steve. I am afraid that the Italian ‘Justice’ System is broken beyond repair right now. It needs a complete overhaul and there is a stalemate between the judiciary whih is a permanent, self selecting oligarchy and the government which has a limited popular mandate and seems to change every year or so. In these circumstances the court system can carry on being an embarrassment to the country pretty much indefinitely because nobody has the power to do anything about it.

Can someone post Steve Moore’s article on TJMK? I don’t visit these websites.

Hi, Helder, Steve Moore’s rants (and his followers in the comments below) would make another interesting case study, they so often leave us shaking our heads..

Yes, a European familiar with the Gladio attacks in Italy might find his comments sinister, but he’s just referring to the L’Aquila earthquake.

I think he’s implying that Nencini ‘destroyed’ the Italian justice system, but who knows what metaphors go on in his mixed up mind?

Sure thing. Steve Moore’s post (absent an image of the mattress) is here in PDF format:  http://www.truejustice.org/ee/documents/perugia/2014stevemooreearthquake.pdf

As you can see it is all rants about North Korea, the implosion of the Italian justice system, and how awed Italians are that the amazing Steve Moore has turned up to help them out of their nightmare.

Its the basic Moore rant “Its all about me! me! me!” and he mischaracterizes or ignores all of the real evidence. No wonder his readers are just a few screwballs.

@Ergon

“I think he’s implying that Nencini ‘destroyed’ the Italian justice system, but who knows what metaphors go on in his mixed up mind?”

How will I inteprete this: “my methaphors in my mixed up mind”? 😊

I will spell it: he talks about a world being shaken by the inprinciple Italian justice. The a picture of a destroyed building (justice building). Then a line about earthquakes probable predictable.

In spite of being an ex pro, he does not avoid suggestive language. Interviewer should ask him about that.

Helder,

Steve Moore, lacking relevance, a meaningful job, or any substance in his future as a media pundit, must inflate every thing his importance to the case, his inexorable ‘enemies’, his ego.

To fit his self-importance, his adversary has to be a whole country, that’s all.

Paul Callan of CNN has already pricked his balloon 😊

Reading Moore’s blog-response to Nencini’s motivazione is like listening to one of the competitors in a shouting contest. Rant is the right word.

His rant is so distracting to this reader that it masks Moore ’s point, but his point seems to be that it is Impossible to Selectively remove only some DNA, and leave behind some other DNA.

Moore ’s assertion is mistaken.

We are dealing with confusing sophistry, and need First to clarify some issues obscured by layer upon layer of his smoke and mirrors:

Re the Possibility of DNA Contamination, one of Hellmann’s “Experts” flippantly tossed-in the response “Everything is Possible”.

If that assertion was applicable to the determination of Reasonable Doubt, Guilty Verdicts could be abolished.

Just flood the deliberations with real, imagined, and fanciful reasons to doubt, as historically succeeded in the OJ Simpson Trial, and has been exploited in this case, using paid Lobbyists to influence Public Opinions about the current Legal proceedings.

As the Hellmann “Experts” have notoriously pronounced that if a single doubt remains, even the slightest, the defendant must be acquitted!

SCC has already decisively excluded such application in its Ruling that the mere assertion that Contamination is Possible is unacceptable; actual evidence that Contamination occurred must be introduced.

This issue of Possibility should apply equally to Moore-assertions of Impossibility.

Moore ‘s assertions here, of the Impossibility of Possible selective removal of stains is not acceptable, actual evidence of such impossibility must be introduced.

SCOTUS in Victor v. Nebraska (92-8894), 511 U.S. 1 (1994), (as pointed-out by Jackie on PMF.org) endorsed a jury instruction on the nature of the Beyond-a-Reasonable-Doubt (BARD) standard that reads as follows:

“..absolute or mathematical certainty is not required.

You may be convinced of the truth of a fact beyond a reasonable doubt and yet be fully aware that possibly you may be mistaken.

You may find an accused guilty upon the strong probabilities of the case…

A reasonable doubt is an actual and substantial doubt ... as distinguished from a doubt arising from mere possibility [think C+V’s “anything is possible” testimony], from bare imagination, or from fanciful conjecture”

To continue:

“The Scientific Police undertook an extensive fingerprinting exercise in the cottage, but found very little of evidential value.
There was a single bloody print left by Rudy Guede in Meredith’s bedroom, but no other prints of his anywhere in the cottage. No prints at all were found in the passage or the the small bathroom adjacent to Meredith’s room. Only one print of Amanda Knox was found anywhere in the cottage.” !

Some fingerprints must have been on Knox’s bedside lamp before the murder, because of it’s repeated use, at least it’s use by Knox.

How can it be possible that after Knox’s bedside lamp had been moved from Knox’s room into the Murder Room, it had no fingerprints on it at all?

Someone Must-Have removed them; not only Must-Have removed Knox’s fingerprints but also the fingerprints of everyone else whose fingerprints may have been on the lamp.

Could the Remover(s) have Seen the prints, or Seen the DNA inevitably associated with them?

Maybe seen Some prints, but not any DNA, because as Moore argues, it would have been invisible to them, without technology they did not have.

So, Unselective removal of footprints, and of their associated DNA, is Not impossible.

Nor do Unselective removers need to actually See what they’re removing. They seem to easily remove stains that are invisible to them.

They can also Unwittingly, but Selectively leave stains e.g. Sollecito’s invisible DNA on Meredith’s Bra-strap, cut-off After her death, and her post-mortem repositioning.

Assertions of possible contamination to explain Sollecito’s DNA are unacceptable for the reasons given above.

Moore is not worthy of our attention.

The desperation of Steve Moore is palatable in the extreme. After all Knox is all he has. He does not have a job with any meaningful regard and therefore money must be tight. In fact the rest of these none entities, Heavey Burliegh etc: are all the same. So therefore the louder they yell the more people they hope will take notice.

I remember a cartoon of Richard Nixon just after Watergate where in the first frame there is a large Nixon and a small caption which stated “I am not a crook” Next frame a smaller Nixon with a larger caption “I am not a crook” Finally a very very tiny picture of Nixon with a huge caption “I am not a crook”

These people are the same because as their credibility gets less, the louder they scream innocent. It’s all rather pathetic.
